A Curlona Case. The Belolt Herald gives tbe particulars of & < curious case which was decided in tbe Circuit Court of Rock Co., Wis., last week. Last winter M. V. l'asco, Esq., postmaster of that city, gave his check to the it. & M. R. R. Co., for the sum of $l,lOO for carry tug the mail. The check was on tlie Bank of Beloit. The bank counted ont i the funds to the agent of tbe road, and then claimed to apply it upon a judgment in favor ot the bank and against the road, and refused to j pay u to tbe agent. On the same day an execntion was gotten out by \Vm. Russell's attorney, and put in tbe hands of Deputy Sheriff M right, against the railroad upou a judgment before obtained in favor of Mr. RusselL Deputy Sheriff Wright demanded of the bauk of ueloit the said 11,100, as the property of tbe Racinc & Mississippi Railroad Company. The bank refused to pav or deliver the lunJs to tbe deputy sheriff, an*d tbe sheriff returned the, execution unsatisfied. On the same day the bank caused an execution to be issued in their behalf on the judgment in their favor, and tbe same was delivered to Rob i ««-tT. Lawton, sheriff of the countr. At Barryvilie and Shohula, fifteen miles west ; of Port Jervis, there was also a violent gale, I which deatroyed the Wire Suspension Bridge ; across the Delaware River, connecting the two j villages. The towers of the bridge were torn : down by tbe violeuce of tbe wind, and the i bridge itself swept into tbe river. Tbe bridge ! was erected 6ome two years since at a cost of ; some $9,000. At Narrowsburgh, the wind struck tbe bridge : across the Delaware River, deflecting the super structure eighteen inches from a perpendicular line. His mother heariug the noise made by tbe fall, immediately ran to the cistern and plunged io, although the water was up to bcr chin. The little fellow bad sank to the bottom, and it was with great difficulty he could be rescued. True to tbe instincts of a devoted mother, she succeeded in recovering him, and stood io that perilous position, with her son high above water, until a ladder was procured by tbe neighbors, by which both mother and child were rescued from their precarious po sition.—Krokuk Journal. Judge Brackenridge of the Court of Common Pleas lor Allen County, has decided that adultery is not a penal offence in Indiana. The* section of the statute fixing the penalty for adultery simply names the,crime without defining in what the crime consists—leaving the common law to de fine what act constitucs it—and such has been tbe cose ever since the State was organized: but there is another statute now in force requiring every offence to be defined by statute, and hence as this is not so defined it is not punish able. This decision is immaterial here, where no case is likely to arise under it, but to our wicked sister cities, Fort Wavne and Indianapo lis, it is highly important.—LafayttU Journal.
