pools under the supervision of tho inter
state commerce commission.
President Roberts said th.t in his jnde
ment the interstate commerce law bad not
operated for the benefit of the public in
the matter of preveutlun dlbcrimtnationa.
He wanted to impress upon the committee
the fact that the law, as now construed,
precluding nillrond companies from muk
in,: arrangements lu reference to traffics
agreements, induces radical Yiolations of
the law l the companies find shipper as
well. The companies were not violating
the section of the law prohibiting pooling,
but, in observing its provisions, they were

did not think that the commU-iion should
bo tllowed to regulate rate, nor was the
pooling system tho beat. Mr. Roberta was
