GRAND JURY PROCEEDING,
(Continued from Pago 1.)
In the matter now brfure this
Courtr relating to the. report of th
Grand ijury, it is the opinion of th6
Court that, having been in session
since the 14th day of the present
month, sufllcieut time was devoted to
dispose of certain matters concern-
ing the public hns been acted upon
and should be reported.
''Jyow the matter yet to be noted
upon and investigated, as stated in
the report presented is that which
refers to the Clerk's ofllce of the
Coyrt, It is tho opinion of the Court
that, if the Grand Jury have grounds
for irregularities in this department
of the Judiciary, then, it is proprr
and It is the duly of tho Grand Jury
to report that they have, reason to
believe that such irregularities exist,
and on receipt of this information, it
will then bo the duty ot the Court to
direct and order the Government to
examine all records" and account
books, of the olBco 'under suspicion
according to law. From the findings
of tho Auditor, if giounds present
themselves tliat will warrant' an in
dictment being found, tho Grand
Jury will be charged accordingly.
"Now therefore the Grand Jury is
hereby ordered to report all matters
and things already acted upon by
them and not as yet presented to
this Court; and upon all matters
under suspicion and which require
expertingof the accounts: the Grand
Jury is hereby ordered to also report
to this Court the existence of any
and al irregularities exjsting in any
of tho departments with such rec
ommendations as the Grand Jury
may deem bcst to make to this
Court."
Tho Court then verbally instructed
the Grand Jury to make the report
above called for, at 9,30 on Thursday
morning
On Thursday morning, upon the
opening of Court, the Grand Jury
appeared and presented their final
cport, a' voluminous document which
will appear in full in tho News next
week, being crowded out this week,
by want of space. The principal
points of tho final report are criti
cismsof the Wailuku Sugar Co. with
reference to tho public roads,
severe criticism of the police depart
ment and recommendations that two
Steers bo suspended, suggestions
incerning Market street and a new
fish market, and a recommendation
tha.t the Tcj-riforial Auditor be re
uesteu to examine the books of the
Clerk of tho Circuit Court, which the
Grand Jury report to have found in
an unsatisfactory condition, and
further recommending that the clerl
be suspended pending tno inves
tigations of the. Auditor.
Tho Court upon receiving tho re
port, ordered it filed, 'and stated
that he would make an immediate
qrder suspending the clerk, as sug
nested, and that the other rccom-
mpndatjons in the report would re
coive his attention ic once. Ho then
discharged tho Grand Jury, in tho
follpwing words:
Gentlemen of tho Grand Jury. I
thank each of you for having, under
taken to perform the said dutie.- in a
manner most satisfactory and pleas
ing the Court, as your report shows
