While the witness testified posi-
vely that ho did not receive any
considnrating for his services nor
ny promise of any it remains that
wilsay was given two five dollar
pieces and but one was claimed to be
usid iu tho attempted bribery and
some would like to know what be-
iimo of the other five.
Deputy Sheriff Lindsay was the
ext. witness called and testified that,
e and Stark were in the adjoining
nom and were looking through holes
n the door and saw Callow place the
loupy on the lap of the judge and
aw Callow go out. Saw tho judge
nick up the money and heard the ar.
angeinent as to the fine and costs.
Fie said he rushed into tho room and
emanded of tho judge the money
Cailo-v had given him and when the
judge denied having taken Hie money
e searcneu uio juuge out lound no
marked money. He admitted having
rranged the sham fight between the
Chinaman and Callow and the details
of the bribery.
j'ratiK atari; tesiined about as
Lindsay did as to first part of the
affuir but said the judge told Callow
to kc'ep (he money as he would need
t to pay his fine but after Callow as
sured the judge he could get more he
said allright. He said the judge
wont out on the end of the veranda
and stood there for a while and then
Lindsay called him in nnd searched
him. While ho was searching him lie,
atark, went out and saw the money
on the ground near where tho judge
had been but cud not pick it up nor
tell any one thaUie hrdsnenit but
after Lindsay and the Judue had
gone he went out and picked up tho
money and went down town and gave
the money to Lindsay.
W. N. Faar for tho defence testi
tied that he had gone to tho stables
with the defendant and that he sat
where he could see him all the time
After Callow came out the dofendan
came to tho door. LindsayUvas righ
ueninu mm. xne ucieiuiani was no
at any time near mauka end of the
veranda where the money was
claimed to have boon found by Stark
A. A. Elias testified as tho former
witness did He was positive the
defendant did not go near where the
mouny was foi n 1.
Judge Recard took the stand in I is
ow.n defence and related how lie had
been sent for and of the three white
men going with him to the. stable and
of the story told him bv Callow and
of Callow placing the money on hi
thk'h. He said he refused to accent
the money and told Callow to keep it
to pay his tine. He said Collow tool
tho money and went out. Lindsay
then came in and demanded the
money Hint Callow hnu given him
and nskod Lindsay to call Callow
which he did. When Lindsay asked
Callow "WJiere is that five dollars'
Callow said what five dollars" Lind
say then became angry and asked
again. Callow then said he gavo i
to the judge. Rpcard then said you
arc a liar. Callow did not reply but
wont out. Ho asked Lindsay to
search hlin but wished to have At
tornoy J. L. Coke present who was
outside at tho time. Lindsay search
ed him and then he sat down an
asked Lindsay to search his shoe?,
Lindsay refused and they went away
Attorney J. u. Uoko trended pos
itively that the defendant did not go
near where the money was claimed
to have been found and proved
valuable witness as were all of th
witnesses for the defendant.
While the ease was ably defended
by Attorney J, L. Coke who seemed
to he perfectly familiar with ovory
move or the witnesses for the pro;
eution and knew of the plan and
every detail of it to entrap the jud.
he declined to argue the ease as h
had been a witness nnd submitted it
without argument Count v Attor
ney D. H. Case made a hard tigh
for the Territory hut in eoi sideration
of the refusal of the attorney for the
defendant to argue the ease he made
a very short ' argument
Judge Kepoikai reviewed tho testi
mony and promptly discharged tho
defendant. In view of the testimony
ho could not have done otherwise.
