The Clerk was instructed to
notify Mr. Omstod that no pay
ment can be made on account of
the strip of land in controversy
unless it be in exchange for a deed
of said strip, and further, that his
power of attorney docs not give
him the right to execute such deed
according to an opinion of the De
puty County Attorney a copy of
which is herewith attached.

by approving Material and Supply,

The Ordinance to amend Section 2
of Ordinance No. 2 was taken up for
consideration. Mr. Church moved
to amend Section 2 of said Ordinance
by striking out the word threo in
line 13 of said Section and substituting
in lieu thereof tbo word "two."
Seconded by Mr. Meyer and carried
Mr. Church moved the adoption of
the Ordinance as amended. Second
ed by Mr. Meyer and carried unani
mously. The Ordinance was number
ed Ordinanco Number 10.

Bond of John H. Wilson be accepted.

Report of the County Supt. of
Roads was taken up for considera
tion. The Clerk was instructed to
notify the County Engineer to take
to Honolulu samples of the heavy oil
from thp residue of the creosoting
plant and tho light oil from the tanks
at Kahulul and havo thesamoanalyz
edj also to have specifications ready
for tho next nicotine of the Board'
for the erection of a 1000 bbl. tank I
and necessary pipe lino.
The County Sunt of Roads was
authorized to puiclinso 3 concrete
pipe forms lor the Mokawao District,
and three for the Wailuku District.

The County Supt. of Roads was
authorized to purchase a 2 horse
road grader for the Molokai District.
The County Supt. of Roads was
authorized to purehaso a set of har
ness and another horse for his use in
his work.

Phenomenal Yield.

The Hail; u Fruit and Packing
Company have about completed their
summer canning of pines.
Tho yield has been more than sat
isfactory. One ten acre tract o
rattoons has produced two hund-ed
and fifty tons of pines or an average
of twenty five tons of rattoons per
acre. This is claimed to bo the larg
est rattoon crop produced in the
Territory.
Haiku is noted for tho pheno.nina
yield of pines per acre. While other
sections produce individual pines as
large or larger than Haiku It is
claimed that no section of the Terri
tory can compare with Haiku in the
yield per acre as a wholo.

Honolulu, October 11. The Sup
reme Court today, in a decision of,
which Chief Justice Hartwell Is the
author, sustained tho Tax Appeal
Court in the matter of the assess
ment of tho Wailuku Sugar Company.
Tho company made a return valuing
its property at $1,700,000. The
asssessor raised it to $2,380,000, and
on appeal the Tax Court decided the
value to be $2,000,000.- The assessor
appealed. The court holds, that
while that lower court mighuproper-
ly havo sustained a higher valuation,

wrong theory or insufficient data,
wherefore it is sustained.

for the Wailuku Sugar Company.

pany at which tlioy offered to com-
promise the suit.
Stops nnd Kiiliuluis Defeated.
Sundny afternoon nt Well's Park the
Morning Stars and Kahului baseball
teams were defeated by the Ilcnlauis nnd
Wniknpus respectively.
The first game was between thf. Stars
and the Ilealanis and the score stooJl7 to
5 at the close of the gnme. The Stars'
hoys were not in form and could not con
nect with the sphere to any ndvnntnge.
It was a slow game throughout.
In the second game the Knhului show
ed up witli two substitutes in place of
Smytlie and Aikala, who wero away from
Kahului, and thus weakened the team to
a certain extent. In the first inning the
Wniknpus scored one run and in the third
scored six, nnd before the game wns up
ndded three more to their score ninking

did great work striking out 10 men hut
did not receive the support from his
players.

Hfieewell Luuu.
A very pleasant farewell luau wasgiven
Tuesday evening at the home of Captain
and Mrs. W. K. Hal in honor of Miss
Hailey, who departed by Wednesday's
Claudine to Honolulu en route to Vallejo,
California, where she will make her fu
ture home with her aunt, Mrs. A linos of
that city.
She was uccompanied by Mrs. linos on
the trip to Honolulu, and after visiting
friends there will leave for the Coast on
the steamer Alameda which is expected
to sail on November 2.
Quite a number of Miss Bailey's young
friends were present and niter' partaking
of the bounteous repast spent the even
ing singing and dancing. All left wish
ing their friend a "bon voyage."
Attempted to Commit Murder.
Oji Monday evening n Japanese woman
was shot iu the stomach by a Japanese
contractor and as a'result of the wound
she may die. The woman was in a bath
house at the Young Hce camp on the H.
C. and S. Co's plantation at the time and
was called outside. As she went outside
a revolver was placed agninstherstomach
and, a short fired. She recognized her
assuilant ns a contractor 011 the planta
tion. The wounded woman was taken to the
Puniieiie Hospitnl where she is being
cared for hut it is believed she will not
recover.
The would be murderer managed to
effect his escape and has not yet been ar
rested by the police.
The cause of the shooting is not yet
known. Some of the Japanese say that
they were formerly man and wife while
in Japan while others deny this nnd say
that the man wanted to borrow money
from the woman who is known to have
considerable ready cash.
