The Semi-annual meeting of the
Association of Maui, Molokai and
Lanni began its session on Wednes
day of last week in Wailuku at ten
A. M. and closed this week on Tues
day. Nearly one hundred pastors,
and delegates reported. The Kaa
huinanu Church has been well fill
ed at all the meetings.
The first adrcss was by the Sec
retary of the Territorial Govern
ment, lion. 13. A. Mott-Smith, who
spoke upon the work of the school
and church in buildini! a bodv
politic strong in morality and
righteousness, which is the foun
dation ot good government. He
said that in his opinion a good
(government could not exist, with
out the aid of the school and
church.
The ndress on Thursday was an
able, interesting presentation of the
subject "Workers together with
God" by Rev. Wm. i. Oleson, the
recently appointed secretary of the
Hawaiian Board.
Anexcellent report of the stand
ing committee of nine showed that
the work of the churches during
the last six months had been suc
cessful. Rev. R. D. l)odgo,the Agent
of the Hawaiian Boaid and local
Treasurer of the Maui Association
and of the Aid Association reported
over $7,000.00 expended during
the past six months in pastors'
salaries and in repairs and build
ing of churches. His report of the
Lahaina Association meeting show
ed an expenditure of over $190.00
in the cost of the last mooting of
the Maui Association.
On Thursday evening mass meet
ings were held simultaneously at
Kaahuiv.anu Church, Waihee and
Waikapu with splendid addresses
by Roys. Oleson, Gulick, Timoteo
and Vice-President of the Terri
torial Christian Endeavor Union,
Peter N. Kohokuoluna.
On Friday, Rev. R. B. Dodge
spoke upon "Prayer, the Heart of
the Christian Religion."' Art ex
ceedingly interesting part of that
days program was the reading of
reports of the church work among
the Hawaiian, Japanese, Chinese,
and English Churches of Maui.
Rev. O. II. Gulick interpreted the
Japanese reports into Hawaiian to
the great interest of the whole
audience. '
A new church organization of
fourteen members was reported at
Ulupalakua, Maui. Over $1100.00
has already been expended upon
thc church building. $800.00 of
which was raised in Ulupalakua.
On Saturday Rev. Ed. R. Turner
delivered a strong address upon
"The Pastor and his Young Peo
ple." In the ovening an excellent
concert under the direction of Mr.
Moses Kauhiinahu was given in
the Armory. After the concert the
floor was" cleared by the townspeo
ple for a dance. This dance was
not in the program of the Associ
ation and hence was not under
their auspicics.
It was n keen disappointment to
the audience that the Waihee sin
gers, who are always so much en
joyed by Wailuku people did not
arrive. Rev. R, 13. Dodge had
made definite arrangements thro'
Sheriff Saffery, who in turn had
ordered , and had ,lfecn promised
that a conveyance would bo at
Waihee at .six o'clock to bring the
peoplo to Wailuku in time for tho
concert. For some unknown reason
the party did not arrive to tho dis
appointment of all.
Sunday was filled with .meet
ings, which began early and lasted
late. The Sunday School exhibi
tion was marked by exceptionally
good music. In the afternoon Mr.
J. Paeli Kalohelani of the churches
of Pelekunu and Wailau on Molo
kai, and Mr. J. K. Kahoopii of tho
church at Nahiku wero ordained to
the Christian niinistory. Rev. O.
II. Gulick preached the sermon
from 1 Cor. 1:28,24, and Rev. W.
A. Oleson gave the charge to the
pastors. Other parts were taken by
Revs. White, Kaaiakamanu and
Kalino. It 'was an impressive and
rarj occasion when fifteen minis
tors laid ordaining hands on the
candidates.
Following this service was tho
reception of seven new members
into the Wailuku Church Their
names are as follows: Mrs. Wm.
Keanu, Mrs. Louisa Mossinan, Mr.
Wm. Keamo, Mrs. Agnes Waiwai
ole, Mrs. Emily Waiwaiole, J. II.
Kala, and Mis3 Minnie Kniuc The
following children were christened
by Rev. R. 13. Dodge: John Umi
Kahookele, Elizabeth Kahookcle,
Likapeku Pun and John Allen
Naone.
In the evening the Kaahuinann
Church was filled by a Roll Call
service of the Christian Endeavor
societies. At the Union Church
Rev. W. R. Oleson preached a
strong sermon.
Monday was. occupied with final
business of the Association and an
address by Rev. Mr. Oleson upon
"The Pastor and his Sunday
School."
A vote was passed thanking vari
ous organizations and individuals
for their generous assistance' in
making the meetings a success.
In connection with the Maui
Association, the Associations of the
Sunday Schools and Christian
Endeavor societies held business
session- and prayer meetings, which
were interesting and successful.
The only unfortunate occurence
during the week was the payment
of a considerable amount of money
from the Sunday School and
Christian Endeavor Associations
to officers for their travelling ex
nouses to General Convention at
Hilo in June, in one case the sum
of 835.00 going to two officers a
$28.00 coining to the general fund
of the Ililo Convention, and only
$20.00 coming to the Kaahunianu
Church to help pa"y the expenses
of the Convention. In the other
case $o'J.00 went to a single in
dividual. Fortunately, for the
good of the churches two motions
were lost by which it was intended
that the four local Sunday School
district superintends should receive
$60.00 each a year for visiting the
Maui Sunday Schools, and also the
motion that the President of tho
(Maui Christian Endeavor societies
should receive $60.00 a vear for
visiting the Christian Endeavor
societies. Had these motions pass
ed, one man by such an arrange
ment would have received $12Q.00
a year besides $10.00 for every
Sunday School rally he attends
Tho good sense of the pastors and
members ot too association was
shown when they refused to pass
such motions to pay men, who had
had no special training to fit them
to lead others in Sunday School
work.
The place and time of the next
meetings were left in the hands of
a committee of nine. The modera
tor for tho next session is the lion
Moses P. Waiwaiolo of Wailuku.

In tlio case entitled long Kai vs
Territory of Hawaii error to Circuit
Court, First Circuit, it was held
that a Deputy of the Attorney
General of the Torritory.is an execu
tive- officer and may decide and act
upon matters that come or are
brought before him, within the
meaning of Section 2o.'3-of the Pena
Laws.
That part of the decision in the
above case that is applicable to the
case before the Court here is as fol
lows :
Tho evidence shows that Mr
Peters was at" the tune deputy at
torney general of the territory. It
is contended that no such olliee ex
ists under our law or that, if it does
such deputy docs not possess the
same'powers as arc vested in the
Attorney General by law and that
therefore, Mr. Peters could not in
any ollieial manner, he concerned
in criminal posecutons. Whethor
or not a Deputy Attorney General
can be appointed with all the pow-1
,.rs of the attorney general need not
be determined. It is sufficient for
the purpose of this case if authority
exists as ve think it does for the
ippointnient of such a deputy with
Mich of the powers of the Attorney
General as relate to the prosecution
of offenders throughout the Terri
tory.
Section 101.. C. L. provides
that the the Attorney General shall
ippcar for the government personal
ly or by deputy in all the courts of
record of this Territory.
In all cases criminal or civil in
which the Government may bo a
party or be interested, and he shall
in like manner appear in the dis
trict -courts when requested to do so
bv the llinh Sheriff or the sheriff of
uiy oue of the islands and (See.
1014) that he shall also be vigilant
and active in detecting offenders
against the laws of the Territory
ind shall prosecute the same with
diligence.
Even if the power to appoint de
puties is not elsewhere conferred it,
is certainly conferred by implica
tion in section lOlo and the power
ind the duty to detect and prose
cute olienders is expresses granted
by the two sections upon the do
puties as well as upon the superior.
That Section 1021 expressly autho
nzes the appointment, under cer
tain circumstances" of a deputy for
any Judicial district does not lriili-
tate against these views.
The legislature, it may be added,
has for many years recognized the
existence of the power to appoint
Deputy Attorney General by mak
ing successive appropriations' of a
salary for that officer.
Deputy Attorney General Whit
ney ;hcn asked whether he had a
special commission for this court
admitted that he had not but that
his commission was for the entire
territory. The Court then ruled
that in the absence of a special com
mission for the Circuit Court of the
Second Judicial Circuit he was not
duly and legally authorized to 'ap
pear helore the court as the Jaw as
laid down in section 1554 is manda
tory and quashed the indictment
and ordered the defendant discharged.
From this it would seem that the
presiding Judge of the Second Judi
cial Circuit has over ruled the Sup
remo Court of the Territory in its
decision in the Tong Kai case.
Deputy Attorney Gcfieral Whit
ney at once wired the Attorney
General of the state of affairs and
requested a special commission for
this court.
The Attorney General forwarded
the Deputy a general commission
and in the commission stated that
it was more particularly for the Cir
cuit Court of the ' Second Judicial
Circuit which commission was filed
in court Wednesday,
As soon as the court made its
memorable ruling County Attorney
D. II. Case entered 11 nolle prosequi
in each of the cases where ail indict
ment had been found. The grand
jury was again empannelled and
new indictments were returned in
each of the eases.
The unnecessary expenditure of
public funds will be considerable
and the delay caused by the mis
carriage will amount to some days.
The fact that Deputy Attorney
General Whitney represented the
Attorney General Department at the
last term ot court and was rccogni; -ed
as the duly qualified representa
tive of t)iat department at the open
ing of the court hero-at this term
and especially by the court at the
opening of the present term when
the com t stated to the grand jury
that Mr. Whitney would represent
the Attorney Generals department
before thein makes the ruling all the
more strange to those not versed in
the technicalities of the law.
As no Deputy Attorney General
of the Territory has a special com
mission nor has had one in the
past it would seem that if .the court
is right in its ruling there is an ex
cellent opportunity to get each and
every person now in prison out on
habeas corpus proceedings not only
,those who have been convicted in
the court here but 111 every court in
the Territory.
Notice to Republicans.
Agreeably to the terms of the
Ollieial Call for The Republican
National Convention to be held in
Chicago on Juno 1(5, 1909, and pur
suant to the rules of the Republi
can Party of the Territory af Ha
waii, the Republican Precinct
Clubs throughout the Territory are
hereby notified to hold primaries
for the election of delegates to a
convention to be held'in Honolulu
on April 1.., 1008, for the election
of delegates to tho National Con
vention. Such primaries shall be
held on Saturday, thnSt.h day of
March, 1908, and shall remain
open between the hours of 3 and 0
o'clock p. m. of said day, and the
precinct roll books shall be open
for the enrollment of members un
til the close of tho poll as afore
said. The judges of election of
each precinct shall furnish the suc-
cessful condidatcs with certificates
of election and shall make report
of the result of the poll to the
Secretary of the Republican Cen
tral Committee, Honolulu.
