Held Dec. 9th and 10th.
Morning Session.
Wailuku, December 10, 1908.
The Hoard of Supervisors was
called to order at 9: 30 A. M.
Chairman W. Hcnning presiding.
Roll call: Present: W. hcnning, T.
T. Meyer, W. P. Haia and W. F.
rogue. Absent : S. E. Kaiue, ex
cused on account of illness.
The minutes of the previous meet
ing were read and the same were
ordered approved as read.
Claim demands were again taken
up for examination.
Mr. Meyer presented Resolution
No. 112 to 1174 inclusive thereby
approving salary, payroll and ma
terial ami supply demands and mov
ed the adotion of the same. Second

sum of 175.50 to the fund known
as Specials All Districts and moved
the adoption of the same. Second
ed by Mr. Meyer and carried.
Mr. Pogue presented Resolution
No. 1170 thereby appropriating the
sum of 8S0.C0 to the fund known
as Incidentals Supervisors and mov
ed the adoption of the same. Second-1

No. 1177 thereby appropriating the
sum of 175.00 to the fund known as

Mr. Meyer presented Resolution

as Furniture and Office Supplies
and moved the adoption of . the

Mr. Haia presented Resolution
No. 1179 thereby appropriating the
sum of $1,120.00 to the fund known
us Wailuku Town Hall and moved
the adoption of the same. Second
ed by Mr. Meyer and carried.
, Mr. Haia presented Resolution
No. 1180 thereby appropriating the
sum of ftiO.OO to the fund known
as Electron Expenses and moved
the adoption of the same. Second
ed by Mr. Pogue and carried.
Mr. Pogue presented Resolution
No. 1181 thereby appropriating the
sum of 825. (X) to tin fund known
as Examination of Chauffeurs and
moved the adoption of the same.
Seconded by Mr. Meyer and carried.
Mr. Meyer presented Resolution
No. 11S2 thereby appropriating the
sum of $15.00 to the fund known
as Telephones and moved the adop
tion of the same. Seconded by Mr.
Ilaia and carried.
Mr. Pogue presented Resolution
No. 1183 thereby appropriating the
sum of 875.00 to the fund known
as Incidentals County Engineer nnd
moved the adoption of the same.
Seconded by Mr. Meyer and carried.
At 12:20 P. M., Mr. Haia moved to
take a recess to 2 P. M. Seconded
by Mr. Meyer and carried.
Afternoon Session.
The Board was called to order at
2 P. M. Chairman W. Hcnning
presiding.
Mr. Pogue presented Resolution
No. 1184 thereby transferring 8110
from the fund known as Roads and
Bridges Molokai to the fund known
as Pay of police and moved the
adoption of the some. Seconded by
Mr. Haia and carried.
At 3 P. Mi, the bids for the con
struction of Section 2 of the Reloca
tion from Pauwela East were open
ed, and resulted as follows:
J. A. Aheong 81931; work to be
completed in 240 days, .certified
check of 8250.00 enclosed.
Concrete Construction Co Ltd.
88495; work to he done in fi months,
certified check for 8250.00 enclosed.
Mr. Pogue moved that the bid of
J. A. Aheong be accepted. Second
ed by Mr. Ilaia and carried.
Mr. Pogue moved that the certi
fied checks of S. E. Kalama nnd
the Concrete Construction Co. be
returned to them forthwith. Second
ed by Mr. Ilaia and carried. (After
securing the signature of the
Chairman of the Board, the Clerk
handed said checks to S. E. Kala
ma and E. P. Chapin, Treasurer
Concrete Construction Co. Ltd.
Report of W. J. Coelho, Chief of
the Wailuku-Kahului Fire Depart
ment was read. Mr. Pogue moved
that the Clerk be. instructed to type
write 7 copies of this report and
furnish each member of the old and
the new Board with a copy of the
same through ' mail. Seconded by
Mr. Meyer and carried. Action on
the report was deferred.
Communication of R. A. Wads
worth, Mgr. Maui Soda and Ice
Works for permission to lay a V$ in.
pipe across the road in front -of his
house was read and the same was
ordered placed on file.
Mr. Meyer moved that permission
be granted provided that he notifies
the road overseer nt least 48 hours
before he does the work and he
must put the road in the same con
dition that it was in Ix-fore the road
was opened up for the pipe. Second
ed by Mr. Ilaia and carried.
Communication of Geo. Groves
Road Overseer to Mr. Pogue notifyT
ing him of the loss of oik; mule of
the Makawao District was read. The
same was accepted and ordered
placed on file.
Statement of the condition of the
Treasury of the County was read
and the same was ordered placed on
file.
Report of the Sheriff for the
month of Novemlnr was read. The
same was accepted and ordered
placed on file.
Report of the County Attorney
was read and the same was ordered
placed on file.
Report of the County -Engineer
was read and the same was ordered i
placed on file. I
Mr. Meyer requested an opinion
of the County Attorney as to
whether or not it was unlawful for
a road overseer to pay less than
81.25 to a road laborer. He ex
plained that he had received an in
timation from the Board that he
should not pay loys men's wages,
and consequently lie had leen pay
ing lnys only 81.00.
The County Attorney expressed
it as his opinion that the lawcis
very broad in the matter, but if the
road overseer thought that a loy
employed is worth only 81.00 per
day, he (the road overseer) is not
violating the law if he allowed only
that amount.
The reports of the Auditor, Treas
urer, Deputy Sheriffs Hana, Maka
wao, Wailuku and Lahaina Sani

haina, Fish and Food Insjnctors

ment of the Poundmaster Kahului
were submitted and the same were
ordered placed on file.
Report of the Sanitary Inspector
for Makawao was read, and the
same was ordered placed on file.
Mr. Pogue moved that the Clerk
lie instructed to write to the Board
of Health to see if the Board will
not transfer the telephone system
from Kalae of Halawn, Molokai to
the care and to lw under the control
of the County of Maui. Seconded
by Mr. Meyer nnd carried.
Mr. Pogue moved that the heads
of departments present an annual
report not later than the 21th of
this month to the Clerk, and that
the Clerk forward a copy to the
members of the old and the new
Board. Seconded by Mr. Meyer
and carried.
Mr. Pogue movel that each head
of Department present to tlie Board

estimate of the total expense for
the coming year. Seconded by Mr.
Haia and carried.
The Clerk was instructed to post
notices in re opening of roads.
Chairman ordered a recess to 7
P. M.
Recess at 5:45 P. M.
Evening Session.
The Board was called to order
nt 7:30 p. m. Chairman W. Hen
ning presiding.
The matter of the claim of the
K. R. R. Co. for lumber furnished
for a pound at Kahului was dis
cussed. Mr. Williams represent
ing the K. R. R. Co. was present
and urged the passage of the bill.
The matter of the amendments
to the Automobile Ordnance was
taken up. A number of citizens
interested were present. Consid
erable discussion ensued. Mr. Vi
vas requestsd permission to nddress
the Board on the matter of the
claim of Eddie Devauchelle of $14
for boat hire. Permission granted.
He urged the payment of the
claim.
The Chairman suggested that in
the matter of amendments to the
Automobile Ordnance that all
parties interested shou'd draft
Bo.nething that all could agree on,
and present the 6ame at the next
meeting of the Board.
The Clerk was instructed to
write to the county Clerks of Ila-waii-,
Kauai and Oahii and ask for
copies of their automobile ord
nances. Mr. Pogue presented Resolution
No. 1185 in re pay of laborers
and moved the adoption of the
same. After some discussion, he
moved that the resolution No. 1185
be referred to the County Attorney
with instructions to report upon
the same by the meeting of the
25th of December. Seconded by
Mr. Haia and carried.
Mr. Pogue notified the Board
that Mr. H. A. Baldwin, Mgr.
Maui Agricultural Co. had been
allowed the use of the rpek crusher
at Paia by the road overseer for a
few days.
The Clerk was instructed to find
out from the Territorial Auditor
the amount due the County of
Maui for the half yearly settlement
soon. to be made.

Mr. Pogue moved that the Clerk
be instructed to reply that no such
office exists.
Communication of Road Over

ers were accepted and ordered
placed on file.
Communication of A. W. T. Bot
tomley for the . Leahi Home was
ordered placed on file. The Clerk
explained that the Auditor had
sent the warrant spoken of in the
communication.
Communication of R. II. Hitch
cock was ordered placed on file.
Mr. Postue moved that the Clerk
be instructed o acknowledge the
receipt of the ame and to forward
his commisson. Seconded by Mr.
Haia and carried.
Communication of Chas. (Jay
was received and actioti on the
same was deferred until the next
general meeting.
Communication of F. F. Bald
win, Mgr. 11. C. S. Co. transmit
ting lease of stable premises was
taken up and the same . ordered
placed on file.
.Mr. Pogu- mocd that the Chair
man be authorized to sign the lease
on behalf of the County. Second
ed 'by M. Haia and carried. Lease
signed by Chairman W. Hcnning.
Mr. Meyer moved to adjourn to
Dec. 15, 1908, at 10 o'clock a. m.
Seconded by Mr. Haia and carried.
