Supervisors
Meeting
Sheriff and Deputy County
Attorney Scrap.
The usual harmony that exist
between t lie County officials was
broken at the meeting of the board
this week when the Sheriff criticis
ed the action of the Deputy County
Attorney for refusing to prosecute
a man who was in charge of the
.Sheriff who the Sheriff claims was
arrested while the Deputy County
Attorney claims the man was not
arrested.
A search warrant was issued for
the purpose of searching certain
premises for liiiuor where liquor is
not authorized to be sold. There
was no warrant issued for the arrest
of any one. The premises were
eearohed and liquor found and
brought to the Sheriffs office.
Tho Deputy County Attorney
held that as there was no warrant
of arrest and no arrest that the
searching of the premises was
illegal and refused to have any
thing to do with the case for fear
of a damage suit.
The Sheriff claimed that theie
had been an arrest and that the
court had ordered the arrest in the
search warrant He claims that
the liquor law gives the right to
search premises without first mak
ing an arrest which contention is
disputed by the Deputy County At
torney. After much discussion of
the subject the board took a recess
and the matter was dropped.
Doctor V. F. McConkey wrote
the Board that there are still some
cases of typhoid fever In this dis
trict. Sheriff Saffery wrote the board
asking for certain improvements
in the j'ail at liana and for repairs
to the jail in Kahului. The clerk
was instructed to notify the sheriff
that at the last meeting the board
passed an appropriation for a new
jail at Kahuiui and could not en-
Uertain the repair of the old one.
Mr. Pogue reported on the pro
posed exchange of lands at liana
for a pnb'ic park and for a sani
tarium in Kula. Both of the plans
of Mr. Pogue were satisfactory to
tho Board and on motion of Mr.
llaia his ac tion was unanimously
approved
County Engineer Hugh Howell
recommended the increase iu pay
of the men who are at work on the
rock crusher which was acted fav
orably oil by the board and passed.
He recommended the purchase of
further spreading wagons as they
are doing the work much more
cheaply and better than can be
done by any other means.
Dr. Win. Osmers was appointed
County Physician to succeed Dr.
Dinegar.
