Making of Applications for
Water Privileges, the Issuance
of Permits, the Establishment of
Rates for Water, and Fixing
Liability for Payment Thereof;
Prescribing Times and Places
. of Payment, and Otherwise De
fining the Privileges, Duties and
Responsibilities of Those Using

waii, that,
'-'1. Application for a permanent
suui'ly tf water from any Govern
inent system, or source of supply,
shall he on the printed form pup-
plied hy the County for that pur
pose, and signed hy the applicant.
Wank applications shall, upon re
ouest, he furnished hy the local
Superintendent of Water Works.
2. The Applicant shall pay, in
advance, at the oflice of the local
Superintendent of Water Works, the
actual cost of all tapping, connect
ing and laying of the service pipe
leading, into the premises upon
which the privilege is to he situated
to a stop-cock inside of said prenns
cs: provided, however, the cost of
such tapping, connecting and lay
niu of service pipe shall, in no
event, he less than $5.00.
All meters shall ho owned hy the
County and shall he under the eon
trol of the local Superintendent of
Water Works, or his authorized
agent.
3. j All water rates shall he paid
(luartcrlv. They shall ho due on
the first days of January, April
July and October of each year;
shall he payable at the oflice of the
local Superintendent of Water
Works not later than fifteen days
after becoming due; and shall he
come delinquent thirty days after
due.
4. In all cases of non payment
of water rates within thirty days
after the same are due, ten percent
in addition to the regular rates
shall he charged to, and become due
by, the person holding such privil
ege; and the local Superintendent
of Water Works shall forthwith
without notice, shut off the water
from such privilege, and charge the
expense of the same to the holder
of the privilege. The water so shut
off from such privilege shall not he
again turned on until the rates for
such privilege and all expenses in
curred, shaH have been paid in full.
f). The owner of the premises
shall lie held responsible for the
settlement of the water rates in
cases when such water rates have
not been paid hy the tenants.
0. Unless authorized, in writing,
so to do, hy the Hoard of Super
visors, persons supplied with water
fwoi the Government pipes, shall
not be permitted to use, and shall
not use, the same for any purpose
or purposes other than those stated
in their agreement, nor shall they
lie permitted to supply, and they
sliall not supply, water in any
manner w hatever to other persons
or property.
'. 7. Consumers Fhall prevent all
unnecessary waste of water, and
shall make no concealment whatso
ever of the pin poses of winch it is
being used; and, unless authorized,
in writing, so to do hy the Hoard of
Supervisors, all water, during sea
sons of drouth or scarcity of water,
shall be used only for domestic pur
poses, and for watering stock, even
though the agreement may permit
the use of water for other purposes.
: 8. No alteration shall he made
(n any water pipe or fixture with
out first giving notice, in writing,
to the local Superintendent of Water
Works, of the intended alteration;

proval thereof.
9. Water rates shall be charged
to and payable hy, the privilege
holder, for all premises, whether
occupied or not, until such time as
the water is, in writing, ordered

11. Persons having irrigation or
other like privileges shall, in cases
of fire alarm, immediately discon
tinue the use of all water for such
purposes and shut off the same.
12. No person other than the
local Superintendent of Wcter
Works or his duly authorized auent,
shall tap the main pipe and turn
on or turn off water therefrom.
13. The local Superintendent of
Water M'orks, or his duly author
ized agent, shall, at all reasonable
hours, be permitted to enter upon
the premises of a privilege holder
for the purpose of inspecting, shut
ting off, or turning on, the water,
or for the purpose of making re
pairs to the service pipes, stop
cocks or meters.

14. All water sold under these
Rules and Regulations in the Dis
trict covered by the Wailuku-Kahului
Water Works System unless
otherwise specially provided hy the
Hoard of Supervisors, shall he
sold by meter measurement subject
to the following rates:
(a) For domestic purposes and
lawn irrigation, where there is not a
proven and acknowledged water
right, four cents per thousand gal
lons, or fraction thereof.
(h) For domestic purposes and
iwn irrigation, where there is not
a proven and acknowledged water
right, six cents per thousand gal
lons, or fraction thereof.
(c) For commercial pui poses
such as the cultivation of fruits and
vegetables, and other plants for sale,
railroads, manufactories, hotels,
lodging houses, offices, stables, and
other business enterprises, seven
and one-half cents per thousand gal
lons, or fraction thereof.
(d) Provided, ho-.-ever, in order
to cover cost of tapping, connecting
and laying of service pipe, meter
inspection and maintenance, the
consumer of water where there is a
proven and acknowledged water
right shall pay a minimum rate of
81.00 per quarter f r water used,
and the consumer who has no such
proven and acknowledged water
right shall pay a minimum rate of
$1.00 per quarter for water used
even though the meter charge for
water consumed may he less than
that amount.

15. All water sold under these

sand gallons, or fraction thereof.
(b) For commercial purposes
such as the cultivation of fruits,
vegetables, and other plants for
sale, railroad, manufactories, hotels,
lodging house, oflices, stables, and
other business enterprises, seven
and one-half cents per thousand
gallons, or fraction thereof.
Provided, however, in order to
cover cost of tapping, connecting
and laying of pervice pipe, meter
inspection and maintenance, the
consumer of water shall pay a mini
mum rate of $1.50 per quarter for
water used, even though the meter
charge for water consumed may be
less than that amount.

1G. All water sold under these
Rules and Regulations, in the Dis
trict covered by the Makawao Water
Woiks System, unless otherwise
specially permitted by the Hoard
of Supervisors, shall be sold by
meter measurement subject to the
following rates:
(a) When the quantity of water
used, during any given quarter,
does not exceed 450,000 gallons, fif
teen cents per thousand gallons, or
fraction thereof; and twelve and
one-half cents per thousand gallons
or all water in excess then of.
Provided, however, in order to
cover cost of tapping, connecting
and laying of service pijie, meter
inspection and maintenance, the
consumer of water shall pay a mini
mum rate of $1.50 tier quarter for
water used, even though the meter
charge for water consumed may he
less than that amount.

SIONS. 17. Rates for shipping: One
half cents per gallon.
IS. In water systems, or por
tions thereof, not provided with
meters for the measurement of
water, unless and until otherwise
directed, the local Superintendent

For all houses one story in height,
covering a greater area than Rix
thousand square feet, there shall be
added one dollar for each additional
five hundred square feet or fraction
thereof, and the further sum of 50
per cent of the first floor rate for
each additional story.
Where a house or building is
occupied by more than one family
the general rate for each additional
family shall be three-quarters ( ?4
of the foregoing rates, except where
two or more families occupy the
same floor, in which case the rate
for each family on the' same floor
all he the rate for the floor sur
face occupied by such family, ac
cording to the foregoing table. The
minimum charge, however, shall be
81.50 per quarter for lawn irriga
tion 'r cent per square yard per
mnum.
For horses and cattle, one dollar
per year for each head.
In all instances where a store and
a residence arc maintained in the
same building, under the control
and in the occupation of one privil
ege holder, all water used therein
shall he charged for at the prevail
ing commercial rate.
19. The local Superintendent of
Water Works or his authorized
agent, shall at the end of each
quarter, promptly make out and
present to each consumer a bill for
all sums then due.
The consumer when making pay
ments for water used and services
given, shall present to the local
Superintendent of Water Wotks, or
his duly authorized agent, the bill
for water received, which, when full
payment is made, shall he stamped
"PAID," together with date of
payment, and signed hy the local
Superintendent of Water Works, or
his authorized agent; and this re
ceipt so stamped, dated and signed,
sliall constitute the consumer's re
ceipt for the payment in full of all
water charges.
20. Each Superintendent of
Water Works shall have charge of
the water system placed in his con
trol; and he shall have authority
to grant and sign all permits for
water privileges and make all agree
ments in connection therewith, so
long as the same are not at variance
with the Rulc3 and Regulations
governing the water system over
which he has control, lie shall he
responsible, on his official bond, for
all government property connected
with and comprising said system,
and for all moneys paid by consum
ers to him or his authorized agent
for either services rendered or water
used.
21. A violation of any one or
more of these Rules and Regulations
shall terminate the water privilege
of the consumer; and the same shall
not be renewed until all water rates
due, together with costs and ex
penses shall have been first paid.

ing devices, shall he and remain
the property of the County of Maui
atoll times, under its control and
he repaired at its expense.
23. Ordinance Number 22, re
lating to the Lahaina Water Works
System, Ordinance Number 23, re
lating to the Makawao ater oiks
System, and Ordinance Number
21, relating to the Wailuku-Kahu
lui Water Works System, and any
and all other ordinances, or por
tions thereof, in conflict with the
provisions of this Ordinance, are
repealed.
21. This Ordinance shall take
effect from and after the 1st day of
July, 1914, and its publication
once a week for a period of two
consecutive weeks in a newspaper of
general circulation published in the
County of Maui, and the posting of
a true copy thereof upon a bulletin
board in front of or near the rooms
occupied hy the Hoard of Super
visors.
