ORDINANCE NO. 28.
Ordinance Cheating an "Engin;
eer's Department for the County
of Maul"; Defining the Functions
of the Department, and the Rules
and Regulations Covering Same;
and Creating the Office of "Conn,
ty Engineer"; Defining His Qual
ifications and Powers and Prcs-i
cribing His Duties and Responsi
bilities; and Repealing Such Por
tion of Ordinance Number 27, and
Other Existing Ordinances, found
to be in Conflict with the Pro
Be It Ordained by the Board of.
Supervisors within and for the Coun
ty of Maul, that: '
Section 1. A department Is hereby,
created to be known as and styled
the "Ennineer's Department for the
County of Maul."
All work of the County having to
do with the designing, surveying,
constructing, care, maintenance, im
proving and alteration of all public
buildings, grounds, sewers, street
lighting, waterworks, public high
ways, roads, streets, lanes, sidewalks,
squares, courts, trails and bridges, and
all material, stock, supplies, machin
ery, tools and other property used in
connection with said work, shall' come
within the scope of the -"Engineer's
Section 2. The office of "County
Engineer" is also hereby created.
Section 3. The County Engineer
shall be a person experienced in nil
public work having to do with the
County Government, and a man cap
able of preparing and submitting,
when called upon so to do, detailed
plans, specifications and estimates
concerning any and all work of a pub
lic character pertaining to buildings,
roads, bridges, water-works, and other
classes, of public works calling for en
gineering skill. He shall not engage in
any private enterprises that will im
pair the efficiency of his Department.
Section 4. The County Engineer
shall be appointed by, and hold office
during the pleasure of the Board of
Supervisors; and shall receive such
compensation for his services as may,
from time to time be agreed upon
between the County and the person
holding or to hold such office.
Section 5. The County Engineer
shall have complete charge of, and
be responsible for, all work connected
and having to do with the Engineer's
Department; as well as have com
plete charge of, and be responsible
for, all property of whatsoever nature
belonging to said Engineer's Depart
ment subject only to written orders
received from t'iO Board of Super
He shall at all times, in all mal'ers
pertaining to the work of his depart
ment arising outside of the usual
routine, keep in touch and confer
with the Chairman and Executive Of
ficer of the Board; shall submit to the
Board, In writing, monthly reports
showing the condition of affairs con
nected w'th his department, woik ac
complished, expcnditiii-es made, and
future requiramentn. Hefore entering
upon the duties of his office, he shall
give a bond o the County of Maui
for the faithful performance of the
duties ot bis office in the sum of
Section 6. Upon assuming the du
ties of office the County Engineer
may appoint, and at any time remove
subject to the approval of the Board,
a superintendent of waterworks for
each of the following district: Wai
luku, Lahaina, Makawao, MoloUai and
liana. He may also appoint and at any
time remove, subject to the approval
of the Board, a district Overseer for
each of the following districts, or
portions of districts, throughout the
County: Wailuku, Lahaina, East Ma
kawao, West Makawao, Molokai and
Section 7. Upon assuming the du
ties for which they are appointed
each of the superintendents of water
works, as well as each of the district
Overseers, shall give a bond to and
in favor of the County of Maui, in
such amount as may be called for by
the County Engineer subject to the
approval of the Board.
Section 8. Each superintendent of
waterworks, and each district over
seer, shall submit, In writing, to the
County Engineer, a monthly report
showing the condition of affairs con
nected with his section or district,
work accomplished and expenditures
. Section 9. Upon assuming the du
ties of his office tho County Engineer
may likewise appoint, and at any time
remove, subje t to the approval of
the Board, a clerk. The clerk's duties
shall be to assist the County Engineer
in keeping all records, maps, books,
accounts, and statistics, and perform
such clerical and office work as may
from limn to time be required of him.
His compensation shall be such as the
Board may from time to time allow.
Section 19. In cases of emergency.
and where, In the opinion of the Coun
ty Engineer, it Is manifestly econo
mical, or otherwise advisable, so to
do, the County Engineer may direct
District Overseers to perforin duties
in districts other than the one for
which they may have been specifical
ly appointed, and It shall be the duty
of overseers to iollow su h directions.
