his seat on tho bench, bowing to the youn
practitioner and thanked him for having
settled a point of law, by swearing to it,
about which he and all the courts had been
in serious doubt for the past twenty-five
Judge French seems to have been placed
under similar obligations to Mr. Toole who
swears that one of the things which he
knows to be true in the complaint and pc
tition for a restraining order against the
Secretary, is, that Sec. 9 of the Census Act
is wholly inoperative and void. Had Judge
French had a drop of tlie milk of human
kindness in his bosom he would certainly
have recognized and acknowledged so im
portant a service to the profession.
A Case Not Kepoiitedin tue Citizen.
Do we hear aright? Is it possible that we
have been deceived in supposing the officers
of Pima County incapable of even attempt
ing to practice fraud or indulge in intrigue?
Explain this case away good Citizen, and re-
iieve it oi tne ugly appearance of corruption
ii Dears on its lace. John W. Leonard Esq,
a prominent lawyer of "Mohave Countv. re
ports to us that he has information that his
name appears in tlie Pima County census
roil, wnercas he has not been in Pima County
since the middle of last April- a month be"-
fore the Census Marshal was authorized by
law to begin taking the census, and more
over he never did reside in Pima, except
temporarily while attending to some busi
ness in the Supreme Court. Quite a noise
"was made over the names of Messrs Alsap
ana Pomroy who had a temporary residence
in Yavapai during the time the census was
being taken, and it would seem but fair for
the Citizen to cry fraud in Leonard's case,
who was at home four hundred miles from
Tucson-attending to business, when the
Census Marshal takes the liberty of placing
his name on tlie Pima County roll. Uow
many such cases might be found if we had
access to the returns as they, have in Tuc
son, is of course not definitely known, and
while we have no Toole willing to swear
by guess, we have sportiwr men who will
bet, which is just as good an argument- and
eught to have as much weight in court- that
oi too e,uua reported as inhabitants of Pima
county at least 4001 of themhavebeensojour-
ncrs or waylerers passing through Tucson
within the past two years. Tho appearance of
.Leonard's name on tho roll, and a knowl
edge t)f the fact that he was not there, nor
hadn't been for a long1 time beforo the law
permitted tho taking of names, leads to
the suspicion that they started in a little
early in the season at leastr anct gives plaus
ability to the theory that they- have been
