Governor And Lihue

Replying to the Governor, Pre
sident Hans Isenberg, of Lihue
Plantation Co., has submitted a
letter which, it is thought, will
clear the situation, the following
being important extracts:
"In order to overcome the many
difficulties that are bound to arise
at the expiration of our leases, the
Lihue Plantation is willing to ren
der assistance to the government
and the homesteaders as far as
reasonably may be expected, realiz
ing that success in the future will
depend for all the parties on fair
business methods and on the will
ingness to give and take. I will
show this willingness on our side
by stating that we will, upon con
dition that we he permitted to
have up to July 1, 1918, to harvest
the Wailua lands and wind up our
business, grant to the government
access to those lands to locate re
servoirs to conserve the water of
the river and to plan means
of conservative distribution. We
are also willing to let the govern
ment begin the construction of any
reservoirs or other conservation
improvements on the Wailua lands
at any time, upon condition that
our water supply rcsetved to us
under the Wailua ltase be not in
terfered with and that our crop be
not unnecessarily injured.
Accept Offer of License,
"In regard to your first letter of
April 18, I beg leave to state that
we accept yonr offer to grant us a
21-year, license for the new rail
road, as stated by you, and we al
so accept your proposition that
'where your (our) company has
fee simple land on which it ob
tains a water supply and is now
desirous to convey it by ditch,
trestle, pipe, flume or tunnel over
government lands to other company-owned
fee simple land, the
government will on reasonable
terms and time errant a license for
the purpose designated," and also
your proposition that where trans
portation facilities are similarly
involved (by which we nnderstand
you to mean that where the com
- pany has fee simrle land on which
it has cane planted and desires to
transport i t across government
land to other company-owned fee
simple land) the government will
by license grant necessary rights-of-way
over government lands,'
both of the latter propositions be
ing conditioned on our granting
to the Territory of Hawaii similiar
rights of way under similar condi
tions over fee simple lands owned
by us."
Regarding the refusal of the
governor to grant a right of way
to ditches and flumes on govern
ment lands, and his propasal to
grant a license instead on "rea
sonable terms," Lihue expresses
the belief that about the onlv dif
ference made will be the using of
some new equipment instead of
old.

lowed $131.85 and charged with
$1674.21, and asks that the same
be examined and approved, and
that a final order be made of Dis
tribution of the remaining proper
ty to the persons thereto entitled
and discharging petitioner and
sureties from all further responsi
bility herein:
It is ordered, that Saturday, the
3rd dav of June, A. D. 1916. at
10 o'clock A. M. before the Judge
of said Court presiding at Cham
bers at this Court Room in Lihue,
Kauai, be and the same herebv is
appointed the time and place for
hearing said Petition and Ac
counts, and that all persons inter
ested may then and there appear
and show case, if any thev have,
why the same should not be grant
ed, and may present evidence as
to who are entitled to the said
property .
