Article 80 of said Constitution.
1. That Article 45 of the Constitution he amended by strik
ing out all after the words ia vested in the King," and sub
stituting therefor the following words : " The House of Nobles,
and the House of Representatives sitting separately, each of
whom has a negative on the other," so that the Article shall
read as follows :
Articlk 45. The Legislative Power of the three Estates of
this Kingdom, is vested in the King, the Hou.se of Nobles, an.l
the liouse of Representatives sitting sparatel, each r.f
whom has a negative on the other."
2. That Articles 4, 14. 15, -6, 3, 19, CO, 01, 03, 44, 47,65,
and 70 be amended by striking out the words " Legislative
Assembly," wherever it occurs therein, and substituting there
for the wor.ls "the Legislature."
X That Article 73 of the Constitution be amended by strik
ing out all after the words ' Laws shall be," and substituting
therefor the words "Be it enacted by the King, the Nobles,
and the Representatives, of the Hawaiian Islands in Legisla
tive Council assembled," so that the Article as amended will
read as follows :
Article 76. Theenacticg style in making and passing all
Acts and Laws shall be, "Be it enacted by the King, the
Nobles and the Representatives of the Hawaiian Islanils in
Legislative Council assembled."
4. That Article 02 of the Constitution be amended by strik
ing out the words " Legislative Assembly," and substituting
therefor the words "each House," and also by striking out the
word " Assembly," wherever it may occur, and substituting
therefor the word "House."
5. That Article 22 of the Constitution be amended by strik
ing out the worJs " Legislative Assembly," and substituting
therefor the word Legislature," and by inserting between
the words "elect by" and "ballot" the word "joint," so it
shall read as follows :
Article 22. The Crown is hereby permanently confirmed
to His Majesty Kamebameba V., and to the Heirs of His
Body lawfully begot ton, and to their lawful descendants in a
direct line-, failing whom, the Crown shall descend to Her Royal
Highness the Princess Victoria K am amain Kaahumanu, and
the Heirs of Her body, lawfully begotten, and their lawful
descendants ia a direct line. The succession shall be to the
senior male child, and to the Heirs of His body; failing a male
child, the succession shall be to the senior female child, and to
! the Heirs of Her body. In case their is no Heir as above
i provided, then the successor shall be the person whom the
Sovereign shall appoint with the consent of the Nobles,
' and publicly proclaim as such during the King's life ;
but should there be no such appointment and proclamation,
( and the Throne should become vacant, then the Cabinet
I Council, immediately after the occurring of such vacancy,
i shall cause a meetins of the legislature, who shall elect by
joint ballot, some native Alii of the Kingdom, as successor to
the Throne ; and the successor so elected shall become a new
Stirps for a Royal Family; anil the succession from the Sover
eign thus elected, shall be regulated by the same law as the
present Royal Family of Hawaii.
6. That Articles 00, 61, 6it, 64, and 65 be amended by strik
ing out the words " Legislative Assembly," wherever they
may occur, and substituting the words " each House."
To ARTICLE 43 of the Constitution granted on the 20th day
of August. A. D. 15C4, in accordance with Article 80 of
That Article 49, be and the same is hereby amended, by
striking out the words " Legislative Assembly," in the first
clause of said Article, and substituting therelor the word
" Legislature." And also by striking out the words " to the
Legislative Assembly, who shall enter the fact of such return
on its journal," and inserting after the words " He shall re-
I turn it," the words "with His objections in writing to that
j House in which it shall have originated, which shall enter the
j objections at large on its journal," so that the Article as
amended will read as follows :
! "Article 49. The King shall signify His approval of any
i Bill or Resolution, which shall have passed the Legislature, by
! signing the same previous to the final rising of the Legislature.
! But if he shall object to the passing of such Bill or Resolution,
He will return it, with his objections in writing, to that House
J in which it shall have originated, which shall enter the objec-
tions at large on its journal, and such Bill or Resolution shall
I not be brought forward thereafter during the same session."
To ARTICLE C2 of the Constitution granted on the 20th day
of August, A.D. 1864, in accordance with Article 80 of
That Article Ci be. and the same is hereby amended by
striking out the words :
And shall be possessed of real property in this Kingdom
to the value, over and above all incumbrances, of one hundred
and fifty dollars, or of a leasehold property on which" the rent is
twenty-five dollars per year, or ol ac Income ol not less than
seventy-five dollars per year, derived from any property, or
some lawful employment."
So that the Article as amended will read as follows :
Articlb 62. Every male subject of the Kingdom, who shall
have attained the age of twenty years, and shall have been
domiciled in the Kingdom for one year immediately proceeding
the election, and who shall know how to read and write, if born
since the year 1S40, and shall have caused his name to be en
tered on the list of voters for his district as may be provided
by law, shall be entitled to one vote for the Representative or
Representatives of that district. Provided, however, that no
insane or idiotic person, or any person who aball have been
ronvicted of any infamous crime within this Kingdom, unless
he shall have been pardoned by the King, and by the terms
of such pardon have been restored to all the rights cf a sub
ject, shall be allowed to vote."
To ARTICLE C3 of the Constitution granted on the 20th day
of August, A. D. 18C4, in accordance with Article 80 of
That Article C3 be am' the same is hereby amended by
striking out the words " and of the electors and also by
striking out the word "increased," and substituting therefor
the word "changed," so that the Article as amended will read
as follows :
Article C-T The property qualification of the Retire.

To ARTICLE C5 of the Constitution granted August 20th,
A. D. 1S04, in accordance with the terms of Article 80 of
That Article 65 of the Constitution cf August 20, 18S4, be
amended to read as follows :
Article C5. The Supreme Court shall consist of a Chief
Justice, and not less than two Associate Justices, any of whom
may hold the Court.
The Justices of the Supreme Court shall bold their offices
during good behavior, subject to removal upon impeachment;
and shall at stated times receive lor their services a compen
sation which shall not be diminished during their continuance.
Provided, however, that any Judge of the Supreme Court, or
any other Court of Record, may be removed from office for
mental or physical inability, by a concurrent resolution of
two-thirds of both branches of the Legislature, and the ap
proval of the King.
The Judge against whom the Legislature maybe about to
proceed, shall receive notice thereof, accompanied by a copy of
the causes alleged for his removal, at least ten days before the
day on which the Legislature shall act thereon. He shall be
heard before the Legislature."
To ARTICLK 71 of the Constitution granted on the 20th day
of August, A. D. 1964, in accordance with Article 80 of
That Article 71 of the Constitution r.f August 20th, 1564, be
amended to read as follows :
Article 71. The King by and with the advice and con
sent of His Privy Council, appoints the Justices of the Su
preme Court, and all other Judges of Courts of Record ; their
salaries are fixed by law.
To ARTICLE 75 or the Constitution granted on the 20th day
of August, A. D. 1SC4, in accordance with Article 80 of
That Article 75 of the Constitution of August 20th, 1SG4, be
amended to read as follows :
Article 75. All Bills or Resolves for raising the revenue,
or calling for any expenditure of the public money, shall
originate in the House of Representatives, after due considera
tion of the revenue and expenditure for the two proceeding
year., and the estimates of the revenue and expenditure of the
two succeeding years, which shall be submitted to them by the
Minister of Finance; but the House of Nobles may propose or
concur with amendments as on other bills.
To ARTICLE 80 of the Constitution granted on the 20th day
of August, A. D. 1?04, in accordance with Article SO if
That Article SO be and the same is hereby amended by
striking out the words Legislative Assembly," after the
words may be proposed in," and inserting the words, "in
either House of the Legislature;' also after the words "ma
jority of the members," striking out the word " thereof," and
inserting the words - cf each House;' also, by striking out
after the words all the members of" the words " the Legisla
tive Assembly," and substituting therefor "each House;" also,
t y striking out aftr the words. ' two-thirds of all the mem
bers of," the word, "the Legislative Assembly ," and substi
tuting therefor the words " each Hiu-," so that the Article
shall read as amended as follows :
"Article SO. Any amendment or amendments to this
Constitution, mav be proposed in either House of the Legisla
ture, and if the same shall be agreed to by a majority of the
members of each House, such proposed amendment or amend
ments, shall be entered on its journal, with the yeas and nays
taken thereon, anil referred to the next Legislature; which
proposed amendment or amendments shall be published for
three months previous to the next election for Representatives;
and if in the next Legislature such proposed amendment or
amendments shall be agreed to by two-thirds of all the mem
bers or each House, and be approved by the King, such
amendment or amendments shall raceme par: r.f the Constitu
tion of this country."

the Constitution granted by His Majesty Katnehameha V., by
the Grace of Ood, King of the Hawaiian Islands, cn the
twentith dav ot August, A. D. 1S64, were agreed to ny a ma
jority of the "members in Extraordinary Session of the Legis
lature of 1S7.1, and were then and there entered cn its journal
with the yeas and navs taken thereon.
