II. A. Burns vs. John Bowler Harris C. J., Judd

JCDD t. DELIVERED TUB 0PIMOM OF TBE COCKT.
In this case the Jury found for the Plaintiff, aod
tbe Defendant moved for a new trial on tbe ground
of newly discovered evidence, which motion waa
heard by the Chief Justice and denied, from which
exceptions are taken to thia Court.
The Defendant contends that if the counter affida
vits had not been considered by the Court below, a
new trial would necessarily have been ordered, and
that tbe practice of filing counter affidavits against a
motion for new trial on the ground of newly dis
covered evidence does not authorize a denial of tha
truth of the statement of what tbe affidavits show
would be testified. ,
We are of opinion that counter affidavits ia such
cases may be filed, aod they will be considered Ly
the Court so far as they throw light upon the
question aa to whether the evidence is fact newly dis
covered and not accessible to the party at the trial,
upon the exercise of reasonable diligence.
Upon consideration of tbe affidavits presented we
aie of opinion that the evidence offered is not of so
controlling and decisive a character as to be pro-1
ductive of an opposite result on a new trial on. the
merits. Now does it seem to as to be evidence which
the exercise of reasonable diligenco on the part of tha
Defendant ooald not have procured at tha trial.

in this case, living in Honolulu and accessible.
There are bat few cases tried in which new evi
dence cannot be hunted up. after trial, and in order
to secure to parties the termination of their legal con
troversies the Court must ta wary about granting
new trials upon insufficient exercises for not procur
ing tbe evidence when the parties had their day In
Court. Exceptions overruled. Ii. F. Bickerton Cot
