On motion of Mr. Place, the resolution (No. 519) of the Board of Aldermen, authorizing the payment of sundry claims, was not concurred in. Mr. Bailey, on behalf of the Committee on Streets and Landings, presented the following report, which was read and received : The Committee of Streets and Landings, to whom was referred the petition of property olders on Saraparu street, Fourth District, traying to be exempted from the payment of 6eir proportion of the cost of laying square )look pavement on each side of the Lafayette tarket, until the whole square shall have been aid, report against the petition, and ask to be tisoharged from further consideration of the subiect. rThe committee report in favor of the petition of citizens to have a flat crossing laid ncross the street, at the tMarigny Buildings on the Levee, and offer a resolution authorizing the Surveyor to do the work. The committee also offer a resolution to an liorizo the Surveyor to purchase oyster shells for the repairs of the Levee in the First Dis trict. The committee also report that it is impossi ble for them to examine into the claims of Thos. Dell and Thos. Buckley, referred to them, with sut having possession or the papers substantiatt ing their demand. This committee, to whom was referred ia reso lution passed at the last meeting of the Board, instructing them to " examine iate and report at lhe next meeting of this Board, the propriety of having the various markets in the city cleaned, sainted and whitewashedo"-report that they fave inspected the several markets of the city, and are decidedly of opinion that they stand in neod of such improvement, ind in addition, that certain repairs are also requiredt; ani they offer ao resolution instructing the Comptroller to sell contracts for the same, embracing the fol lowing markets, viz.: the St. Maory's and Poy dras Markets in the First District, and the Beef, and Vegetable, and Treme Markets in the Sec ond bistrict. the title to thetngnazine street 3Iarket being in dispute, the committee, before suggesting im provements to the same, ask tlhat the subject bo referred to the Judiciary Cotmmittee, with in structions to report as soon as practicable, as to the proper action to be taken by the Council, end offer a resolution accordingly. The conmnittee do not embrace in this report any recommendation with regard to the Vege table Market of the First District, the repairs to which would require the expenditure of a considerable sum of money, and nas the revenue derived from the farming of this Market is com paratively small, they doubt the policy of jm proving it, and they consider it questionable hbether it wouldenot be of advantage to the revenues of the city to sell the whole property. The committee ask that this sultbect be re ferred to the Improvement an Bullilding Com mittee, with instructions to report on the sub jet as soon as the some can be properly cou sidered. On motion of Mr. Summers, the Surveyor was instructed to inform the Board as to the nature of the information requireSl, and why he cannot get possession of plans and documents in the archives of the late Municipality No. One. Mr. Watkins, on behalf of the Judiciary Com mittee, presented the follbwing, to lie over: The petition of snudry citizens, asking this Council to be informed why the Canal and Bank ing Company has not erecoted a bridge across the New Canal, at the intersection of St. Paul and Liberty streets, in accordance with a resolution of the Second Municipality Council, adopted on the 25th March, 1852, approved by the Mayor on the 27th of the same month, and published according to law, in the official journal; having been referred to the Judiciary Commuittee, the undersigned beg to report that, having exam ined the charter of said Company, they find it expressly stipulated that the Company "shall make and keep in repair, bridges, suitable for the passage of carriages, where the said Canal shall intersect any of the streets in the snburbs of New Orleans, now established, etC., and that the city is " empowered to make such regula tions as are deemed expedient, relative to the making and repairing of the roads, bridges, causeways, etc.," and to "open nad improve streets, etc.," under certain regulations. By reference to a survey of the city, it would op. pear that St. Paul street was laid out, as far back as 1820, and that, as a consequence, the Company is bound to erect a bridge across the Canal, at its intersection with said street; and farther, that it is fully competent for the city to erect bridges over said Canal, at the interseo tion of suich other streets as ehave been laid out subsequent to the date of the charter of said Company. As the Company has neglected and refused to erect the bridge ordered iy the reso lution above referred to; and as it is to the in te est of many of our citizens residing in the neighborhood of and on toe line of the New Canal, your committee ask leave to oifer the ibl lowing resolution: Jeo. Resolved, That the Comptroller he authorized to sell at auction, to the lowest bidder, after due notice in the official journal, the contract for building a bridge across the New Canal, at the intersection of St. Paul and Liberty streets, or at the intersection of Magnolia street: provided the Canal Company should consent that a bridge shall he crected, at their expense, at the inter section of the latter street, in accordance with plans and specifications in the Surveyor's office; said sale to he subject to the appl oval of this Council, and payment to be made out of any money in the Treasury not otherwise appro priated. Resolved, That, in the completion of said work. it shall he the duty of the Treasurer to present a bill for the same to the Canal and Banking Company for payment, and should said Company rrthse sr neglect the payment thereof, then it shall be, and is hereby made, the duty of the City Attorney, to institute suit flrth aith, to recover the amount paid for said bridge, and also take legal measures to annul the charter of said Company. - Mr. Stetson, on- behalf of the Police Cozmmit tee; presented the following reportse and resola tions, and, the rules lbeing suspended, they were read twice and severally adopted: The Police Committee to whom was referred the petition of Mr. Benj. On motion of the same amember, the resoln tions passed by the Board of Aldermen, author izing the Surveyor to repair the Treme Post, and put a new pair of stall's to the Police Jail, was concurred in, with amendments as follows: Resolved, That the Surveyor be, and lie is hereby, anuthorized to nmake all necessary repairs to the Tremto Post, provided the cost shall not exceed one hundred and fifty dollars; and also, to put a new pair of stairs to the Police Jail, or repair the old one, provided the cost shall not exceed one hundred dollars.
