In support of this position, a great deal of time was socupierdl rsowieg that the declaios were not law ; that nothing could be properly called o, but those acts passed by that branch of our government, in whom the power of legislation is vested by the Constitution. This is true, and we nevrer before supposed that they were so consid ered. But as we aro obliged, by our duty to decide on every question that is brought before as, and as many of these questions turn on ascertaining the true meaning of the law-makers, when the expressions used sre amblgu ous, whether that ambiguity be consldered in relation to the Ilnguage used In the ate, or the applicability of the prvision to particular asss, I had supposed it not doubt ed that the doaisions of this tribunal were to be regarded as the interpretation of the legslative will-a- an expres sion of its meaning and intentian. Are not the decisions which thIs court mates amid the frequent confliting oplnious of foreign Juries, to hbe re ceived as determining which doctrine is in force here? We aretold not; that recourse mnst be had to the law itsslf, and that law Is found where ! in some obascure com mentator, who lived, perhaps, some centuries ago, nnd who Is quoted,triumphantOly, as bettr evlidenee of what is a rule ofeotlon for the propie of Louisiana, than the de cielons of men, who, whatever in other respecIs he their abilities, have, at least, the advantage of using the know. ledg.andlearning that later tImes have predused-wko senjoy the llght of the agein which they live, and who have the aid ofable eousel, dsoaassing every subjsect on which they are called to pronounce an opinion. This, then, is the fair extent to whith the authority of the deciseons ofthis tribunal may (36817) be carried. They are evidease of what the low Is, under such clrcumsltau oees, as has been just stated, and as is the duly of the Court to se that they are correct, and that they are uni form; so, ale0, is it important that society should know that we toeel Oselves bound by them, unless we are clearly and beyond doubt satisfied that they are contrary to law or the Constititution and that we never can consider it a proper diseharge of duy in any member of ths bar who purmues his pro.essedlon with an avowed determination to disregard them. IIt i no answer to this resuning to say that the law I different from the decision of the Court, for that Is beg ging the question, and taking for granted the very poinet which the court has otherwise decided. On thlis view of the saubjsot, I need not examine the difference between the authority to which deolsions under our law are entitled, and those of the Courts of England; many of the latter, as wee truly stated, turn on the com mon law; many af them, however, grow.out of the expres stons used In their statutes, and are given In expounding them. Nor is there any assumption of power In givling the decisions of this court the authority Just spoken of. The tribunals of the last resort, in every State of the Unioln, hold the same doctrine, each in relation to their awn judgments. We yield, therefore, to the stern power of necessity; who, as everybody knows, bath no law: in which particular, she and Judge Cotton are exactly alike-as has already beenmade fully to appear to all who chance not to be aware of it. Heretofore, the number of these was very great; being exactly equal to that of all those who had never heard of him as either the brief less lawyer or the lawless Judge. Now, how ever, all that has been changed. The envious veil of obscurity, which till now concealed Cot ton from the world's adibiring gaze, hath been drawn aside; the cloud that covered him hath been blown away by the breath of the Press. Cotton himself, who slept supine and as if for ever, in the maternal lap of oblivion, hath of a sudden waked up, as Lord Byron did one morn ing, ind found himself famous. Thrice happy Cotton! The renown which others are fain to work out by toil, he hath achieved without an effort. Others attain to a painful celebrity only by their knowledge: he hath accomplished an equal one by his ignorance ! But while we thus resound the praise of Cot ton, let us not forget that something is due to our own. Save for our trumpet, where were Cotton's fame ? What Agamemnon owes to Ho mer, or Degberry the elder to Will Shakespeare, Judge Cotton owes to us. And herein lies our triumphant vindication from the ill-judging blame of some who deem us to be persecuting the admirable Cotton, while, in truth, we are but making him what he never made for him self-a reputation. Had Cotton, the poorest of sticks, remained a little " limbof thelaw ;" had he not, by dema goguism, grown dip into a tree, under whose shade people must sit, perforce, for protection, we should never have sung of him. Had he rested content in his natural negativeness, a harm to no one but the very few and foolish clients who employed him, who would ever have molested him? Not only would it have been inhuman to do so, but impossible: for who could have found him? When, however, no longer modest, he aspires to the ermine, and, harmless no longer, gets it, he becomes a rock of offence and a stone of scandal, against which all who pass for justice by the way where lies the block of his ignorance must break their shins, if not their necks. It then grows impera tively the duty of every body to remove that stumbling-block out of this great highway to men's rights. More especially does it become the duty of us of the Press, surveyors and in spectors of that and of all other public ways, as we are, to stop not and stint not, until such a grievous impediment, such a wanton and fool ish hindrance to Justice-the great end for which society is instituted-be cast out from the place which it encumbers and where it only offends. But even this is not all: bad enough was it that Cotton should be a judge; bad enough that he should, from his puny tribunal, deal out injustice to the suitors of a single un fortunate district: but when, dissatisfied with his petty sphere of wrong, he emerges frogi it, claiming to upset those supreme decisions which alone can bring a remedy to the existence of such a magistrate as he is; when, in short, he would set himself up to re-expound to the Su preme Court what they have deliberately settled in an opposite sense, to break down with his shallow-pate all rules, all precedent, all author ity, so that the entire State shall stand in the condition of his own district, and have no law in it: why, in that case, Judge Cotton, ceasing to be the mere plague of a neighborhood, rises into the nuisance of the State, and must be abated. As his great prototype, Dogberry him self, says, "it is tolerable and not to be en dured," that a man capable of pronouncing such judgments and of supporting them by such authorities as he produces to sustain them, -should sit upon. the judgment-seat, in any country of Jurisprudence.
