Be it enacted by the Senate and ,ouce of Representatires of the Sntate of Louis. ifana i, General Assembly convenedt, That the act entitled an act providing a remedy against usurpatloo, Intrusion into, or the unlawful holding or exercising a public ffce or franchise ai this State, approvel September eight (8), eighteen hundred and ixtykeight (1868), be and the same is hereby amended ad re-enacted so as to read as follows: That an action by petition may be brought before the proper distriLct oourt or parish court by the district attorney or district attorney pro tempore, and for the parish of Orleanso by toe attorney general, or any other person interested, in the name of the State, upon his own information or upon the information of any private party stainst the party or parties offending, tn t he fol lowing cases: First-.When any person shall marp, Intrude into or unlawfully hold or exercise any public office or franchise within this State ; or Second-When any public officer shall have done, or suffered to be done, an a^t which by the provislone of law shall work a forfeiture of his cffice; cr Third- -When any association or number of per. sons shall act within this State as a corporation without being duly locorporated.
