The Fifth Amendment to the
Constitution of the United States
provides among other things that
"No person shall be held to answer
for a capital or otherwise infamous
crime unless on presentment or in
dictment of a grand jury, except in
cases arising in the laud or naval
forces or the militia, when in actual
service in time of war or public
danger."
In a free government, regularly
operating in its legitimate sphere,
no imaginable condition of things
suspends for an instant the Consti
tutional privileges or safeguards of
the citizen and in determining the
probable necessity for the present
ment of an indictment of a citizen
his Constitutional rights shoud not
for a moment be lost sight of.
Under these instructions you are
to examine fully and fairly all mat
ters called to jour attention by the
Court or prosecuting attorney, or
should any member of the grand
jury have cognizance of any matter
or thing necessary to have the at
tention of the grand jury, it is his
duty to present it and to give all
information necessary to a proper
investigation.
You must not permit the accused
or his attorney or his witnesses to
appear before you, or to discuss with
you at any time or place any mat
ter which may have been made,
may bs or become a matter for your
investigation. You have no discre
tion in this matter; n juror who re
veals any part, detail or circum
stance which has or is taking place
before that body, except to the !
Court or the prosecuting attorney 1
except as otherwise heretofore pro
vided for, is amenable for contempt
and severe punishment. The rea
sons for such restrictions you will
at once recognize as necessary, but
it is not a subject which you, as
grand jurors, can discuss it must
be implicitly obeyed.

any member of the grand jury, may
administer the oath to witnesses or
others sworn by you.
Should any witness, duly sub
poenaed by you according to law,
refuse to appear before you, or ap
pearing refuse to answer any ques
tions which should properly be put
to them by you, you should also re
port them promptly to the Court.
To Hud an indictment there must
be a concurrence of at least twelve
jurors.
In addition to the foregoing ob
servations, you will be furnished
with a copy of the rules provided
by our Supreme Court under the
provision of Section 83 of the Or
ganic Act, which will guide you in
the transaction of such business as
may come before you as to the
swearing of witnesses, presenting
indictments, your attendance, etc.
In making your final report you
may make such observation and
suggestions as in your judgment
public justice and the good of the
community require.

tile Wednesday stage from I.anpahoehoe to Honokaa will be held to connect with it.
On Mondays following the arrival of the Manna I.o.i in Honuapo on Sundays, the
leaving time of the stage for Iaupahochoe from Hilo is changed to 10:00 a. 111., and
the Honokaa stage is held at Iuip.ihoehoe to connect with it.
Aside from carrying of express matter and passengers these stages carry U. S.
Mail, so patrons may rest assured of prompt connections.
