IJouril of llciilth or n licensed pliysi-
uinu tlio llreiiien could not lmye
opium in their possession while in
port. Tlint every Custom liouso
olllccr should notify the Cnptnin or
olllcer in chnrgo of nny vessel and
produce his commission prior to
making a search. If ho does not
notify them then tlio ship can bring
an action against him for trespass.
In tho evidence it was stated and
uncontradicted Hint an olllccr, one
of the engineers, was present. The
prisoner had no right to question
Mori-ill or to assault him as he was
not, even accused of having opium in
his possession. The trunks were
opened by tho men themselves and
tlin trouble arose hiibscmientlv on
deck. If Morrill had trespassed and
been ordered to leave the ship then
a icasonable amount of foice might
bo used to .eniovc him ; if the pri
soner were allowed to do it lie would
be usurping the position of the Cap
tain and might next proceed to throw
the Captain overboard. He consi
dered that a breach of the peace had
occurred within the jurisdiction of
tlio Court and lie fined the prisoner
810 and costs 81.10. An appeal to
tho Intermediary Court was noted.
Mr. Hatch appeared on behalf of
the Oceanic S. S. Company.
The question whether the Agents
or Captain of the 0. S. S. Co. have
any right to authorize their Chinese
firemen to use opium remains un
settled and the company will doubt
less experience much dilliculty in
shipping firemen on their return to
San Francisco. The Compnny can
settle this question by bringing an
action against the Custom House
olllcer for trespass inasmuch as he
had not notified the Cnptnin of his
proposed search or produced his
commission. Another question tlint
, should be decided is If this, being
an American ship, is subject to the
laws of Huwaii. Wc think it is so
while she is in port here but it would
be as well to have the matter settled
definitely. If the O. S-. S. Co's ves
sels can bo searched when alongside
the wharf why cannot those of the
P. M. S. S. Co. be searched while
they are alongside the wharf, even
though only in transit?
