inquests and our .statute law re
lating thereto, arc reasonable and
Hiigycstive, but not so strictly accu
rate in every particular as to be
above criticism. An executive of
ficer cannot be justly blamed for de
fective legal enactments: his duly is
to administer the. law as lie llinl it.
Hut when ;i legal enactment confer-,
on an executive ollleer discretionary
power, that olliccr is responsible for
the proper exercise of Unit power.
In pursuance of such povicr, .an of
ficer may bo loo hasty in action or
too slow to move. In either case lie
is censurable.
Allowing thai our law "only or
dains an inquest, when any person is
'supposed to have come to his death
by poisoning, violence, oriimny sus
picious manner,'" and admitting
that " the question whether there
4 has been poisoning, violence, or any
suspicious circumstance in cornice
lion willi the event is left to the
judgment of the Coroner," we can
not hold our Coroners blameless for
their exercise of judgment. There
is seldom any "suspicious circum
stance" connected with tho numerous
Miiddeu deaths which occur in this
disiiicl, according to the "judg
ment" oflhc Coroner ; consequently,
investigation hy a Jury is extremely
rare. AVIiereas, in the public judg
ment, iinlauces have been quietly
ignored in which were "suspicious
circumstances," calling for inquiry.

inquest when the law does not say
that he should."' It certainly would
be unfair to censure a Coroner for
not holding an Inquest when the law
prohibits his doing so. Hut when
the law neither commands nor for
bids, the Coroner is required lo use
his own judgment as to Ihe proper
course lo follow; and if lie does not
adopt the course dictated by com
mon sense and a legard for the com
mon good, he is chargablc with non
fulfilment of duty, and should lie
taken to task therefor.
Hut we contend that the law, as
wc find it in .Section 1510 of the Civil
Code, is often positively disobeyed;
for it is there commanded that "as
soon as any Coroner shall have
notice ol the death of any person,
within his jurisdiction, supposed lo
have come to such death by poison
ing, violence, or in any suspicious
manner, lie shall forthwith issue his
summons to six good and lawful
men," who shall proceed to inquire
"when, how, and by what means"
deceased "came to his death." Is
this always done ? Is the Coroner
in the habit of summoning a jury to
inquire into tho when, how, and
cause of death of every case repotted
lo him. "supposed lo have come lo
such death by poisouiug,. violence,
or in any suspicious manner ?" If
cases of supposed poisoning or
where .suspicion reasonably exists
receive attention, how about those
caused by violence ? Death by vio
lence does not necessarily imply vio
lence inflicted by the hand of man.
A man may come to his death by
being gored by an animal, or being
run over by a dray, or by a fall from
an eminence. In either case it is
death by violence, and according lo
law should be inquired into by a
jury. The late Governor of the jtiil
apparently came to his death by vio
lence. There may have been di
vided opinions as to the precise
nature of that violence ; but it was
pretty clearly death by violence
Therefore, it was a case which the
law provides shall be investigated by
a coroner's jury, and there should
have been no hesitation in the mind
of the Coroner, when first notified,
respecting what ought to have been
done.
Although we are of opinion that a
defective law is not wholly respon
sible for the short-comings of the
past, we readily admit that the law
is deficient and requires amendment,
and purpose returning lo the subject
on some future occasion. In the
meantime, we indulge the hope that
the law as it stands will be more
carefully observed than hitherto.
