Ilolokahiki vs. Geo. "W. Lincoln.
Appeal from Police Court to Inter
mediary Court. Plaintiff claims 8200
damages for distrainment of articles
for rent, from premises occupied by
defendant as a law ofllce on Bethel
street. The Court sustains defend
ant in the distrainment, but dis
approves of his keeping tho key of
the office for a few days, as that
amounted to an eviction of plaintiff
from premises. In view of the cir
cumstances, plaintiff is awarded
8250 damages, with costs against
defendant. It was remarked by the
Court that of late cases had come to
its notice where there had been irre
gular proceedings regarding the dis
' traint of goods for rent. The tenant
should have an inventory handed to
him of the goods intended for dis
traint and a list stuck up on the
premises Vfith notice of what the
landlord intends to do with uicm,
and thus ho would be freed from
any damage that might be claimed.
