MAXWELL CHANT DECISION.
Washington, April 19. To its
decree on tho Mnxu ell Grant matter,
yesterday, the Supreme Couit ap
pended some general instructions to
the lower courts upon the nnture
nnd importanee of land patents that
will do much to clear away tho fog
that has stuiounded the instrument,
both in the Executive Department
and in the courts. While it ailhms
emphatically the right and Jurisdic
tion of tho Court to investigate and
grant relief when the issuo of a
pntcnt naB been based upon uatttt
or mistake, it draws tnc attention or
the courts to the fact that 11 patent
is tho highest evidenco of title, as
well against tho United States as
against privato individual. Its
effect upon the rulings of Ihc In
terior Department in land matters is
thus stated by one of the principal
law clerks of the Attorney-General's
olllee, whose duty jt is to write a
decision for the Secretary's signn
tiiio and to reccommend tho bring
ing of suits for annulment of patents.
It will not change greatly our course
of proceeding hero, for this olllcc has
at all times been exceedingly careful
in its recommendations for suits 'of
this character. Patents cannot bo
attacked upon trivial charges or
raero reports by special agents. We
require the affidavit of special agents
and we lcquire the affidavits of at
least two reputable witnesses to a
charge of fraud before we will re
commend a suit to be set aside. It
is true that the General Land Ollluo
holds that any technical violation of
law constitutes fraud, and insists
that a transfer of laud if discovcicd
afterward is ample testimony upon
which to base a suit to set aside a
patent. The department does not
agree with that, however, and on no
such evidence would it recommend
such a null. This 'is one of the
reasons why suits .to set aside
patents held by lumber and iron
companies charged with acquiring
land through settlement by an indi
vidual cannot be successfully main
tained. Wo arc governed here by
tho rulings of tho Supremo Court in
the case of Mcycis vs. Cruit, 13
Wallncc, Housed Statutes, Section
291, in which the Court held that
the tiansfer of land upon even the
day of final proof of transfer, proved
up with clean hands, must convey a
title which can never be attacked.
This has been the basis of our ac
tion. While the Couit's decision in
the Maxwell case will not change
our course of action, it will do much
to enhance the sacredness of patents
and discourage attacks upon titles.

THE CONSULAR SERVICE.
In Ilussia wo have 17 consular
ofllcers, only 2 of whom aic citizens
of or owe allegiance to the United
States. In Austiia we have 13 con
sular representatives, ,j of them
native or naturalized citizens. In
Franco there are 7-1 consular ofllcers
of the United States, 22 of them
Americans. In Germany there aio
Gu' consuls and consular agents, 2G
of them citizens of the country
whoso flag they fly. In Italy, out
of -It consular representatives of
the United States, only 13 have
been from this country. In Spain,
out of 82 American consuls and con
sular agents, only 13 are citizens of
the United States, and many of our
consuls there are unable to speak
jury languago but Spanish. In Tur
key wo have 35 representatives, 7
of them Americans. Should troublo
aiiso with Great Britain, where one
would think thoro would be the
least dilllculty in finding an Ameri
can representing American com
mercial interests, it appears,
from n recent report of Consul
General Waller of London, that
"there aro now in the consular
corps of Great Britain and Ireland

Englishmen," Consul-General Wal
ler adds: "The icason that so
small a proportion of tho consular
places in this country is held by
Americans undoubtedly is that the
compensation such places now offer
is entirely too small to (induce com
petent Americans to leave their
countty to enter the service."
