a little beyond Coco Head. The tug
Elcu goes there this afternoon and if
the weather is line to-morrow the ca
ble will be laid from there to the lee
end of Molokai, a distance of about
twenty-feeven miles.

cases of John F. Howler vs. The
Board of Immigration, and A. b
Clegliorn, Colled or-CJonoiul of Cus
toms, vs. W. S. Luce. In the lb st
case the demurrer of defendant was
sustained. The Atlonicy-Guncial
who appeared ex officio for the de
fendant, had presented a bill of
cotd for taxation and S23i?.fJ0 at
torney 'd commissions. Plaintiff ap
pealed against, paying costs to the
Government. In the second case
the bot was put on the other leg,
by the defendant's demurrer being
sustained against the Government.
Tho Attorney-General appeared for
the Government, as in tho other
case, and the defendant (Luce's)
counsel filed a bill of costs and
S27S1.31 attorney's commissions.
Judge Dole allowed the costs in
both cases and the -appeals against
his decisions upon them wcic heard
together by the full Court. The
majority decide that in cases where;
tl e Government is a party costs and
attorney's commissions cannot be
.taxed for or against the Government.
The dissenting Justice holds that
principle or precedents are not the
question, but what is the law. Ilo
claims that the law provides taxation
of costs without distinction upon
the losing party, without any excep
tion being made oC Government

POLICE COURT PROCEEDINGS.
When the Court opened this morn
ing, Kahalewai, the late Captain of
the Household Guards, charged with
treason, was brought up. The pro
secution asked that the case be con
tinued to the 17th. Paul Neumann
appears for him.
A ollc pros, was entered against
Ah Sun and Ah Hop, who were ar
rested at Ewa on a charge of having
opium unlawfully in possession.
Two Chinese, Ah Toi and All Lee,
were charged with having opium un
lawfully in possession and remanded
to the 21st.
William Perry, l'upuli, Naihe,
Palau, S. Kila, lloomanawanui and
Nahinalau were charged with riot
and unlawful assembly. They all
waived examination and were com
mitted for trial to the next term of
the Supreme Court. S. Kane ap
pears for Nahinalau and Kila, W. C,
Achi for lloomanawanui, and J. L.
Kaulukou for the other four defend
ants. Jack Kuamoo and Kauhikoa; both
charged with treason, were remand
ed to the 17th. W. C. Achi appears
for Kuamoo, and J. W. Kalua for
Kauhikoa.
Joseph Kawa was lined SO for
furious and heedless driving, which
charge he tried to lay on someone
else.

Perhaps if the Mulual'-t claims to public patronage could be as clearly shown there in the inc eha-ste and
elegant style which has been adopted here, the verdict of New York might go with that Company next year.
Without dwelling upon the Mutual's record in the past which has been in the main a good oue, its present
standing, and its prospects for the future are the points that a prudent business man would inquire into.
Compaiisons of the present standing of these companies have already been made by me, not with figures of
my own, but from statistics furnished by Insurance Reports, Companies' Statements and other data sent to mu
from the Home Olllces of the Kquitablo.
These figures I contend are entitled to us much credence as ny figures furnished in like manner by the
Mutual Lif to its representatives lieie. To show clearly, the natural trend of these Companies towards the
future I beg to submit the following comparisons covering a period of the past five years.

Whenever a Company allows its surplus to become so depleted that a dead loss for the year is shown in
stead of a jnin it points to reckless financial management and ultimate ruin.
It should be remembered that the Mutual is doiug almost entirely a Tontine business now under the nam
Qf "Distribution" Policies, and although it adopted this method of Insurance as fnr back as 1S8-I not one dollar
of surplus has as yet been apportioned thereon.
With its scant general surplus the prospects of good future dividends is certainly not encouraging.
Comparisons of Increase in Premium Income, Increase in Total Income, New Husiness, etc., etc., might be
made in like manner as the above, and with like results, but the above seetu stilticieut to forecast the future.
That the Equitable in its 30th year should have met and pased a Company which had hitherto beeu all
conquering, a Company which had had its own way for 10 years before the Equitable was born, is quite suttl
cientto account for the jealousy displayed by the Mutual's representative.
1 simply refer to the Equitable Record as an authority and claim that it is entitled to as much considera
tion as the Weekly Statement, a paper issued iu the interests of the Mutual Life and which has been in circula
tion here for many years.
With these remarks I close the controversy as far as I am concerned, and positively and flatly refuse to in
dulge hereafter in a discussion which on the one side seems to have developed into bitter personalities instead of
open manly argument.
