Be it Enacted by the Queen and the LetMature of the Hawaiian Kingdom : Section 1. Thoro shall bo established in the General Post Oflico at Honolulu, as a part of the Bureau of tho Hawaiian Postal Service, a Savings Bank to bo known as tho " Hawaiian Postal Savings Bank," of which the Poslmastor-Goueral shall bo ex-qfficio manager. Section 2. It shall bo lawful for the Postmaster-Gonoral to authorize and direct such of his oflicers as ho shall think fit to receive deposits, and to pay tho same, together with tho interest accrued thereon under such regulations as may be prescribed under tho authority of this Act; provided always, that such deposits shall not bo of less amount than one quarter of one dollar, or a multiple thereof. Section 3. Every deposit received by any officer so au thorized by the Postmaster-General shall be entered by him at the time in tho depositor's book, and the entry shall bo attested by tho signature of the said officer. This entry on the depositors book with tho attestations of the said officer shall bo conclusive ovidonce of tho claim of tho depositor to tho repayment of such doposit with interest thereon on de mand made by him in tho manner hereinafter provided. Section 4. The officers engaged in tho receipt or payment of savings deposits shall not discloso tho name of any depos itor nor the amount deposited or withdrawn except to tho Postmaster-General, or to such oflicers as may bo appointed by him to carry this Act into operation. Section 5. The books of the Hawaiian Postal Savings Bank shall bo opened, and the manager shall receive all de posits offered on and after the first day of January, A. D. 1885. sat Section G. Married women and minors may in their own right, make deposits and receive repayment, giving valid re ceipts therefor; provided however, that minors under tho ago of fifteen years can only give a valid receipt therefor upon tho countersigning of the same by their natural or legal guardian. Section 7. In case any depositor shall die, loaving a sum of money on doposit in tho Postal Savings Bank not exceed ing one hundred dollars ($100), and letters of administration or notice of existence of a will bo not produced to the Post-mastor-Gcneral within a period of sixty days after tho death of the depositor; or in case of disputes of any ouo claiming to be entitled to any money deposited in tho Postal Savings Bank under ono hundred dollars ($100) as assignee, executor, administrator or next of kin to tho depositor, tho matter may be referred in writing to a Justice of tho Supreme Court, whoso award or order in writing shall bo binding and conclu sive on all parties to all intents and purposes without airy appeal. Section 8. In case any depositor shall die, loaving any sum of money on doposit in tho Postal Savings Bank, ex ceeding one hundred dollars ($100), tho same shall only bo paid to the executor or administrator on tho production of letters of administration. Section 9. If a depositor become insano, having on do posit not oxcooding ono hundred dollars ($100), tho -Postmaster-General may in his discretion authorize payment from timo to time out of tho funds of such depositor to any person having charge of him. Section 10. On demand, by notico upon tho Postmarttor Gonoral in such form as may bo described in tho regulation's under this Act, by a depositor or party legally authorized to claim on account of a depositor for repayment of any doposit or part thoroof, such depositor shall bo absolutely entitled to paymont of any sum not exceeding ono hundred dollars ($100) which may bo duo him within thirty days after giving such notico; and shall bo absolutely ontitled to paymont of any sum or sums ovor ono hundred dollars ($100) which may bo duo him within ninety days after giving such notico, and tho officor making such repayments shall enter tho same upon tho book of tho depositor and attest tho entry by his signa ture. Provided however, that payments, may bo made to depositors, in tho discretion of tho Postmaster-General, on demand, or at any time prior to tho periods mentioned in this Section. Section 11. Tho rate of interest payable on doposits made under this Act shall not exceed six jior cent, per annum on deposits amounting to live hundred dollars ($fi00) and under in any ono account, and shall not exceed five per cent, per annum on all amounts oxceeding five hundred dollars ($.'500) in any ono account, but no interest shall bo paid upon do posits exceeding at any ono time two thousand five hundred dollars ($2,500) in any ono account, and no interest shall bo paid on any doposits made after September 510th, A. D. 1892, oxcooding fivo hundred dollars ($500) in any ono account. Intorest shall not bo calculated on any amount loss than lio dollars or some multiple thoroof, and shall not commence until tho first day of tho ce'endar month next following tho day of doposit, and shall ccaso on tho first day of tho calen dar month iu which such doposit is withdrawn. All deposits not exceeding twenty-five hundred dollars in any ono account that shall have boon on doposit two months prior to July 1st of each year, shall not bo assessed for taxes and shall bo froo from all Government taxation. Section 12. Interest on doposits shall bo calculated to tho 31st day of Decombor in ovory year, and shall bo added to and bocomo part of the principal monoy, and tho Post-mastor-Goneral shall on that day of each yoar furnish tho Minister of Financo with a sworn statement of the rate of intorest and tho amount thereof, calculated and actually passed to tho credit of tho depositors on tho books of the Postal Savings Bank. Section 13. All moneys received by tho Postmaster-Gonoral as deposits iu tho Hawaiian Postal Savings Bank in excess of twenty-five huudred dollars, shall be paid in tho Treasury; and the Registrar of Public Accounts shall open in the books of tho Treasury an account to bo called tho "Hawaiian Postal Savings," to which ho shall credit all de posits made on this 'account; and ho shall debit such sums as may bo withdrawn on warrants issued by tho Postmaster Gonoral for paj'ment of sums duo to depositors. All moneys received to this account as well as the reserve in tho hands of the Postmaster-Gonoral as cx-qfficio manager of the Ha waiian Postal Savings Bank shall bo deemed and treated as part of tho public debt, for which tho Treasury is responsible to tho depositors, and tho Treasury account shall on the first day of January of each year, be credited as of that day, with tho interest actually allowed and paid to depositors under this Act for tho previous year, ending December thirty-first. Section 14. There shall bo at all times lotained in tho Treasury as a special reserve to moot tho demands of depos itors in said Postal Savings Bank, not less than ten per cent, of tho doposits in such bank on all deposits up to an aggre gate of fivo hundred thousand dollars ($500,000). Section 15. If at any time tho monoys paid into the Treasury on account of the Hawaiian Postal Savings Bank, and the intorest accrued thereon, shall be insufficient to meet the lawful claims of tho depositors, it shall bo tho duty of the Minister of Finance to pay tho amount of such deficiency out of any moneys not otherwiso appropriated, and report said amount to the next ensuing Legislature. Section 1G. An annual account of all deposits received and paid out under authority of this Act, and tho expenses incurred during tho year, ending December 31st, together with a statement of tho total amount duo at the close of tho year to all depositors shall bo made by tho Postmaster-Gonoral to the Minister of Finance, who shall lay the same before tho Legislature at its next ensuing session. Section 17. The Minister of Financo is horoby authorized to issue coupon bonds of tho Hawaiian Government up to tho amount of one million dollars, to bo styled tho " Postal Savings Bank Loan," to bo issued to depositors in tho Ha waiian Postal Savings Bank, who may apply for tho same to bo mado payablo in periods, not loss than Jivo, or not more than twenty yoars, at tho option of tho Minister of Finance, and to bear interest at tho rate, not to oxcood six por cont. por annum, to bo paid semi-annually, principal and interest payable in gold coin of tho United Stales of America or its equivalent. Any" such depositor with an aggregate credit on his pass book of not loss than two hundred dollars in gold coin of tho United States of Amorica, which shall havo been on doposit at least three months, who shall apply to tho Postmaster-Gonoral for such bonds, shall bo ontitled to an issue of an amount thereof in sums of ono hundred dollars or multiples thereof, which amount shall immediately bo with drawn from said depositor's uccount with tho Postal Savings Bank. Section 18. In ordor to give greater security to deposi tors in tho Hawaiian Postal Savings Bank, and to facilitate tho repayments to depositors in case of withdrawals of dopos its in excess of tho ordinary course of business, tho Minister of Financo is horoby authorized to issue coupon bonds of tho Hawaiian Government for tho amount of Postal Savings Bank doposits on doposit in tho Treasury on tho first day of July, 1888, and on tho first days of January and July of each yoar hereafter, ho is horoby further authorized to issue such bonds up to tho amount of tho not Postal Savings Bank do posits paid into tho Troasury during tho six months noxt pro coding such date of issue, with tho amount of tho intorest credited thereon and added thoroto on Decombor thirty-first Of each yoar. Section 19. Such bonds shall bo of a denomination not loss than ono hundrod dollars ($100), and shall bo redeem able not loss than fivo nor more than twenty yours aftor dato, and shall boar intorest itt six por cont. por annum, principal and interest to bo paid iu gold coin of tho United States of Amorica or its equivalent. Thoy shall express upon thoir face that thoy are issued as security for tho Postal Savings Bank deposits, and are nogotiablo only upon tho endorsomont of tho Postmastor-Gonoral and tho Minister of Financo with tho consent of the Cabinet. Section 20. Such bonds shall bo hold by the Postmastor Gonoral in trust aw' security for doposits in tho Hawaiian Postal Savings Bank, but ho shall not draw the intcrast there on, and bofore negotiation of such bonds as provided by law, it shall bo his duty to dotach all inteiest coupons on the bonds that havo accrued and doposit tho same in tho office of the Minister of Finance whoro they shall be cancelled. Section 21. In the event ol demands for withdrawals of doposits from tho Postal Savings Bank in excess of tho ro sorvo on hand or available at tho Treasury, tho Postmaster Gonoral with tho written consent of the Cabinet is hereby authorised to borrow suflicionl monoy to moot such demands, upon the lowest terms obtainable, and give such bonds, or any necessary portion thereof, as security for tho monoy so borrowed ; or ho may with such consent as aforesaid sell a sufliciont number of such bonds after first advertising for tenders therefor to tho person or persons making oilers tho most advantageous to tho Government, and apply tho pro ceeds to tho payment of such demands. Section 22. If tho Postmastor-Gonoral shall at any timo withdraw from the Troasury moneys deposited thoroin by tho Postal Savings Bank, for which bonds shall havo been issued as aforesaid, ho shall at tho same timo surrender to tho Troasury bonds, tho par value of which shall equal tho amount so withdrawn, which bonds so surrendered shall bo forthwith cancollod by tho llcgistrar of Public Accounts as redeemed bonds. Section 23. Tho Postmastor-Gonoral witli tho consent of the Cabinet may make, and from time to timo as ho shall sec occasion, alter all needful regulations for carrying this Act into execution ; and after publication, such regulations so mado shall bo binding on tho parties in the subject matter hereof to the same extent as if such regulations formed part of this Act. Section 21. All expenses incurred in the execution of this Act, shall bo paid out of tho appropriations for tho Gen eral Post Office. Section 25. Tho passage of this Act shall in no way change tho status of tho doposits now in tho-Postal Savings Bank either principal or interest ; and nothing herein con tained shall be construed to moan any interference with such deposits, principal or interest. Section 20. Chapter XLVI. of the Session Laws of 1881, Chaptor XXXIV. of tho Session Laws of 188G, Chapter XXXVIII. and XXXIX. of tho Session Laws of 1S88 and Chapter X., XI. and XII. of tho Session Laws of 1890 aro hereby repealed. All moneys horotoforo collected and now un expended, and all monoys which may hereafter bo collected under any existing or future statute authorizing tho collection of any hospital tax, shall bo paid into the Public Treasury and hold by tho Minister of Financo, as a spocial doposit to tho credit and for tho benefit of tho Trustees of the Quoon's -Hospital. Section 2. Such spocial doposit shall at all times bo sub ject to tho ordor of tho said Trustees or such officor thereof as may bo by thorn authorized, and shall bo by such Trustees devoted to tho purpose of such Quoon's Hospital. Tho restrictions imposed by Chaptor XIII. of tho Laws of 1870 upon tho killing'or destroying of imported foreign birds is horoby rqmovod and abolished as to tho bird called tho mynah bird. Section 2. Nothing horoin contained shall bo hold to re.r poal or abolish said Chaptor XI II. of the Laws of 1870 as to any bird or animal, excepting tho mynah bird. Approved this 7th day of September, A.
