Chief Justice Judd has rondorod
an equity decision in tho case, pre
viously described fully in this paper,
of Aone vs. O. K. Kapulo and C,
Afong. Kapulo was charged with
having mortgaged lands to Afong,
tho deod of which ho had obtained
fraudulently from Aono and his wife
Nakahuua. Tho Court holds Mr.
Afong to have boon an innocent
party, directs that tho mortgagee's
sales shall go on, and gives judg
ment against Kapulo for $025 and
costs. .Should tho mortgage bo satis
lied before certain of tho lauds aro
sold, then Kapulo is to roeonvoy
such lands, or such portion as may
remain unsold, to tho heirs of Aono.

A Native Man is Shot Through
A Friendly Challenge Ends Fatally The
Homicide Behind the Bars.

Station ho imparted tho news thnt a
innn had boon shot dead at Palolo
Valley. Police Captain Hopkins
was soon on tho way anil found a
man lying on the veranda of a two
story house at Palolo, dead.
The following particulars have
beon gathered from several wit nessos
of tho shooting. A native named
Hail canio down from a house farth
er up tho valley and nfter partaking
of breakfast with tho people of tho
houso wont upstairs and brought
down an old musket which was used
for scaring off chicken thieves. Hau
sat on tho stops and commenced
monkeying with tho gun, not know
ing it was loaded. Ho did not know
how to handle a gun. Two' or three
times lie pointed tho gun at a wo
man sitting near him, saying ho
would shoot her. Sho replied that
she was not 'afraid, because tho
thing was not loaded.
A man named Kanoakalau was
standing on tho veranda at the timo
watching tho other two fooling with
tho musket. Finally Hau put tho
stock on tho ground nnd holding
tho gun obliquely upright pulled
tho trigger. Like a Hash the gun
wont off, and tho charge of shot hit
Kanoakalau on tho right sido of tho
head above tho cheek. He fell down
unconscious, although ho breathed
