But Established for the Benefit of All.

Mr. Thurston assumed in the
Legislature to-day that the paying
of Government employees at the
end of the month depended on the
appointmout of a now Cabinet. The
fact is the enabling Act for the pa'
meut of salaries did not run past
September 30, and thoro is no autho
rity to pay them until the Appro
priation Bill is passed. This cannot
possibly be done beforo the end of
this month anyway. Those respon
sible for the delay are tho politicians
who sprung tho vote of want of con
fidence on tho Legislature, largely,
if not chiefly, so that tho Ministry
should not have credit for tho policy
of retrenchment they wore ready to
submit.
A CONSTITUTIONAL BRIEF.
"Tho Constitution" is tho title of
a lawyer's brief in this morning's;
Advertiser.' It opens with tho broad
statement that "tho Hawaiian Con
stitution of 1887 introduced in its
entirety tho systom of ministerial
responsibility which has grown up
in England by tho slow process of
centuries, and which has served as
tho typo of constitutional liberty for
almost all tho nations of Europe."
The articlo goos on to maintain, in
effect, that tho precedents of Eng
land's unwritten Constitution aro
authoritative in construing Hawaii's
written Constitution. This conten
tion goos too far altogether. Ample
proof can be furnished in our Su
premo Court Reports that our writ
ton law does not run beyond either
its obvious or construed intent. Tho
limited scope of tlio common law in
this kingdom is evidence against tho
contention in question, at least in its
full significance. Some States of the
American Union adopted tho Eng
lish common law at tho outset, as it
ran in tho Colonial days, but these
States in voluminous instancos havo
enacted laws to supersede the com
mon law. The common law of one
day is likewise superseded by the
legislation of tho next day in Eng
land itself. Even tho unwritten Con
stitution of England is subject to
sudden changes. Tho conditions lead
ing up to such changes aro usually of
slow, almost imperceptible growth,
but tho precedent that frequently
remains binding for an indoiinito
time is made in a moment. Leaving
aside such precedents as aro made
by the Executive and which become
binding if followed by a succeeding
Executive, it is enough to say that
thoro is no constitutional limit to
tho power of tho Euglish Parlia
ment. Parliament can wipo out tho
monarchy to-morrow and establish
a republic, and tho act will bo con
stitutional so far as that goes. If
England should adopt a written
Constitution to-day, it would prob
ably contain soino limitations on
this supreme power of Parliament.
Tho Hawaiian Constitution liko the
Constitution of the United States is
, a writton one. And liko that of tho
Unitod States it strictly limits tho
powers of tho Executive, tho Legis
lative, tho Judiciary. 'When thoro is
any question raised as to the true in
tent of tho instrument, it is decided
by tho Supreme Court by the same
principles of construct ion as would bo
omployed in tho case of statute law.
English procodontis only cited when
thoro appears to bo nothing in tho
contoxt or circutnstaucos which is
adoquato to solvo tho original iutont
of tho instrument. But American
precedent has boon cited as authori
tatively when it has fitted an omorg
ouoy, Part of our Constitution is

itntos Constitution. In viow of
those facts, what nonsense is it to
ay that tho written Constitution of
Hawaii must bo construed by tho
unwritten Constitution of England!
Tlio Advertiser's attorney is un
fortunate, however, in his applica
tion of English precedent to our
present situation. His sweeping
jlaim that this kingdom is under
English law in respect to ministerial
responsibility carries him much
further than ho would probably be
willing to go. Without splitting
hairs as to details of procedure, it is
admitted that our written Constitu
tion requires the retirement of a
Ministry upon a vote of want of
confidence passed by a majority of
the elective members of tho Legisla
ture. Although tho provision is
only a negative olio, forbidding the
Sovereign to rotnovo a Ministry ex
cepting upon such a vote, still in
tho nature of things no Ministry
would delay resigning thoir commis
sions after tho Legislature had voted
want of confidonco in thein. A voto
of want of confidence is tho only
reason why Ministors should retire
or bo removed in Hawaii oxcopt
voluntarily, or in case of impoach
niont or conviction of felony. In
England a Ministry is oxpocted to
resign or olso appeal to tho country
under other circumstances. Tho
defeat of an important ministerial
measure has tho same effect as a
direct voto of want of confidence.
When thoro is irroconcilablo dis
sension in tho Cabinet which
becomes public is another recog
nized cause for tlio rotiromout
of a Ministry. Such an exhibi
tion as was mado by tho Koform
Ministry horo in 1890 would bo
impossible in England. Tho dif
ferences between Mr. Thurston and
Mr. Ashford would havo had to bo
composed in Cabinet councils, or tho
whole Ministrv should havo surren
dered their commissions to tho King.
In any of tho cases montioned, how
ever, tho English Ministry has an
option to avoid resigning which has
been mentioned, already. That is,
they may advise tho Sovereign to
dissolve Parliament, so that they
may appeal to tho people in a gen
eral election. If our writton Con
stitution, as tho brief under review
states, "does not protend to recito
everything which is necessary to give
effect to its provisions," and "the
methods of administering this S3'S
tem" in European countries and
"above all" in "England must bo
authoritative for Hawaii," then
there will probably novor bo a case
more peculiarly calling lor tho
English appeal to the people than
the present deadlock in Hawaii. Wo
aro not advocating such an appeal,
remember, as wo boliovo it is hotter
to keep within tho terms of our
written Constitution. Tho espouse
of a general election is too groat, and
its disturbance of business too
serious, to make us readily advocate
oven tho insortion of such a pro
vision in tho Constitution as would
givo a Ministry tho power of dis
solving tho Legislature, especially
when our Legislature's term is only
two years against tho English Par
liament's seven.
Tho key to Ministerial responsi
bility in England is that tho Ministry
is responsible to Parliament and
Parliament again directly to tho
people by tho practice of having a
dissolution of Parliament when Min
istors think that tho majority in
Parliament does not represent tho
majority of tho people. Again, this
test of tho confidonco of tho people
and Parliament in tho Ministry as a
wholo is supplemented by tho fact
that Ministers, while holding office,
must bo members of Parliament of
either HousOj and if of tho elective
branch must submit to an individual
tost of tho reliance of tho people in
thorn by resigning and being re
elected by thoir constituents as
members of tho Ministry. Neither
of these foundation stones of tho
"system of Ministerial responsibility
which has grown up in England"

Constitution of 1887. Both by di
rect constitutional nnd legal pro
vision and by implication thoy aro
excluded from being brought into
actiou, tho clause providing for a
dissolution of tho Legislature in tho
old Constitution having boon do
liboratoly omitted in tho now. Tho
premise upon which tho Advert isor
bases its dissertation having been
thus shown to bo absolutely uutruo,
it is scarcely necessary to follow up
its tangled wob of half-truths and
misstatements in order to show that
tho Queen reigns horo strictly ac
cording to tho constitutional limits
with which tho act of 1887 sur
rounded tho Sovereign.

morning on Kaaialii, ono of tho char
acters in tho "Wooing of Kaala," is
roalistio of its nature and character
istics. Kuaialii does not njoan "the
man who oats chiefs," but it means
"tho royal food" or "tho chief's
food," and might bo translated
frooly, "who oats with tho chiefs."

MISS ARMSTRONG'S SUICIDE.
Sho Lost Her Fortune in Throo Bays
at Monto Carlo.

cide of Miss .lane Armstrong of Now
York after sho had lost a fortune at
Monto Carlo.
Miss Armstrong was an orphan, 20
years old. Sho sailed from Now
York early in August, nnd, after
having visited friends in Triosto,
wont to Vontimiglia, about twenty
miles from Nice. Sho first wont to
tho Casino at Monto Carlo on Sopt.
8. Sho played insanely tho first day,
and won l(H),(XK) francs on tho
"twenty-four." Sho was so possessed
of tho desire to try hor luck again
that sho stopped wi ' acquaintan
ces over night at a hotel near by,
that sho might begin playing as soon
as possible on tlio following day.
As on the first day tho "twenty-four"

at tho table from midday to mid
night, and quit it $200,000. losor.
On tho third day sho recovered
what sho had lost and left the Ca
sino, saying that sho was ill and
would novor play tho game again.
Sho returned, however, and began
bottintr on the "twenty-four." She
lost steadily until hor wholo fortune
of 5250,000 was gone. As tho crou
pier took in hor last gold coin sho
roso and loft tho Casino. To an ac
quaintance, who mot hor at tho door
and remarked on her paleness, sho
said that sho had lost all, and was
going to friends in Trieste, who
would see that sho got back to tho
United States. Sho did not no to
Triesto, however, but shot herself in
a room in a villa at Vontimiglia.
Tho usual effort was mado at
Monto Carlo to suppress tho news,
and tho report was sent out that tho
Miss Armstrong who had killed her
self was an elderly lady who had
left Monto Carlo for Triesto soino
days boforo, and had committed sui
cide there. Two men, said to bo
Englishmen, who had lost all their
money at tho Casino, sprang into
tho sea on tho night of Miss Arm
strong's suicide. Those suicides also
aro denied by tlio Monto Carlo peo
