Tho petition makes tho following
statements: Defendants aro in pos
session of certain lands adjoining
thoso of complainant on tho
south and southwesterly sides
and lying at a higher altitude.
Tho natural How of water from
a spring on defendant's lands lias
always been upon complainant's
lands and at times of heavy rains it
i i it i i i
runs into tlio boa. water nas neon
taken by complainant from such
natural ilow for tho pasj. .0 years for
its sugar plantation. Defendants
aro about to divert tho water from
complainant's lands, contrarj- to
equity and good conscience, and, un
less such diversion is immediately
stopped, complainant's plantation
will suffer irroparablo loss, damage
and injury.
Therefore tho Court is asked to
enjoin immediately tho defendants
from so diverting tho water and,
upon hearing of tho petition, to
make tho injunction perpetual. The
petition is sworn to b' .). B. Atlior
ton, secretary Koliala Sugar Co. "W.
R. Castle for tho petition. Judgo
Biekerton on November 10th ordered
tho issue of a temporary injunction
to restrain tho defendants from any
interference with tho ilow of water
and to abide tho further ordor, judg
ment or decree ol tho CJourl, com
plainant giving a bond of $1000 for
costs.
Defendants in thoir answer to the
petition deny that thoro is a natural
Ilow from tho spring in question to
tho lands of complainant, that com
plainant has taken wator from said
spring for 30 years, and, generally,
that complainant has any right to
the wator from tho spring. They
admit that thoj' intend to ufeo the
wator from tho spring for watering
live stock on thoir laud, but deny
that such use would interfere with
any right of complainant. Where
fore tlioj' pray tho bill may bo dis
missed with costs. F. M. Hatch for
defendants.

Tlio scheme of tlio Hawaiian
Hardware Co. to ak for suggestions
for a Christinas Dinner is a novel
one in Honolulu and tho number
that have filled the Bvi.i.nTiN's mail
during tho past ten days is convinc
ing proof that the avorago house
wife cau devise ample means of till
ing one's soul with gastronomic deli
rium and their systems with dys
peptic tendencies.
It was hoped that tho ladies who
had combined to submit a menu for
a typical Hawaiian dinner would
have carried out their intention ovon
though theirs might not have taken
a prize; the form would have been
an excellent one to have gone to the
many hundred readers of the But.Ln
tin in foreign lands whoso idea of a
native feast is confined to tlio con
tents of tlio cook book whoso com
piler makes dog tho niece de rcxixtance,
and a peace oH'ering in the form of
a pipe made of sharks' teeth as tho
final to tho meal.
Mnnv of the menus submitted
wore lacking in conditions of tho
contest and were consequently do
barred. Some persons neglected
to give either the price of tho course
or tho total cost of tho meal. Still
another sent in a bill of faro with
thirteen courses and wines and esti
mated tlio cost at &1.80. This, of
course, was thrown, out by the
judges because it was' clearly a case
of falsifying tho returns.
Tlio professionals preserved a
dignified silence in tho contest and

tho digostivo organs of their guests

In tho absence of airy professional
menus being handed in Mr. Hondry,
tho enterprising President of the
Hawaiian Hardware Company, in
structed us to mako tho 5 prizo a

second best menu. Tho judges, Dr.
Geo. Trousseau, Dr. Jno. S. McGrow
and F. M. English, three gentlemen
whoso authority on the subject of
good dinners is unquestioned, have
decided after a careful and pains
taking examination of tho hundreds
ol menus submitted, mat t.no one

suflicionlly dyspeptic to entitle her

Besides tho culinary gems printed

of spaco forbids our making them
