To Consolidate and Amend the Law relating to the Vending'
of Goodh, Wares and Merchandise within the Hawaiian
Be it Enacted by the Queen and the Legislature of the Hawaiian
Section 1. The several laws unci parts of laws mentioned
in tho first' schedule hereunto annexed shall bo and tho saino
are hereby repealed ; but nothing herein contained shall alToot
any license, now in forco, to vend goods, wares and merchan
dise within this Kingdom.
Section 2. The Minister of the Interior shall grant to any
person applying therefor in writing, a license to soil goods,
wares and merchandise for the torni of ouo year, which shall
bo known as a "Merchandise License"; such application
shall bo undor oath, and shall contain a statement of the
average monthly receipts of the applicant from sales of mer
chandise during the preceding twelve months",iand if the
applicant shall not have previously held a license to soil mer
chandise, then a statement of the oxpocted average monthly
sales during the succeeding twelve months ; and shall stato
tho location of the applicant's 2)lace of business and the kind
of articles he intends to sell, and shall be substantially in tho
following form, to wit :

Section 15. No person or persons holding any liconse un
dor this Act shall permit or allow any transient or other
agent to work undor their names or license undor penalty of
forfeiture of such license.
Section 4. All licenses issued under this Act shall con
tain a condition that tho licensee shall not sell or furnish
opium or any preparation thereof, nor anj' poisonous drug,
without license obtained according to law, undor pain
of tho forfeiture of his liconse, and incurring tho penult'
proscribed by law for that offense; and that ho shall
not sell or furnish spirituous liquors or other intoxicating
drinks, without express liconso thorofor obtained according
to law, upon pain of forfeiting his liconso and incurring such
penalties as the law may from time to time prescribo for sell
ing or furnishing liquors or other intoxicating drinks without
liconso, and shall stato tho place or limits within which tho
licensee may sell. Liconses granted undor this Act shall not

or merchandise of foreign product or manufacture without a
liconso or in contravention of tho conditions expressed in his
liconse, or of tho provisions of this Act, upon conviction
thereof before any Magistrate shall bo fined in a sum not ox
ceoding five hundred dollars, or in default of payment, im
prisonment at hard labor not oxcoeding six months, in tho
discretion of tho Court.
