a new trial is ordered of tho ojoct
inout suit of J. I. Dowsott vs. Mau
keala and othors, in which a mixed
jury rendered a verdict for defend
ants last term.

Ho was convicted in the Honolulu
Police Court last Julv for uartiei-
patiug in a lottery known as cho fa
and appealed. On tho '2JU1 of Feb
ruary last ho moved in tho Circuit
Court for a discharge, on tho ground
that thu Act of 188G had been re
pealed by tho Lottery Bill of Janu
ary lit last, and specifically by Act
21 of tho Legislature of tho Provi
sional Government ou March 7.
Section 12 of Act 2L prescribes that
prosecutions pending under tuo re
pealed law shall not bo affected by
tho repealing act, and section 23 of
the Civil Code is in general terms to
the same effect.
Judge Whiting over-ruled tho mo
tion for discharge of defendant, aud
an appeal was taken against his de
cision to tho Supremo Court. A de
cision of tho full Court, by Chief
Justice Judd, has just boon filed,
sustaining the decision of the Cir
cuit Judge. It liolus that tno prose
cution of defendant should bo pro
ceeded with under tho Act of 1880.
Tho motion to dismiss is over-ruled
aud case sent to tho Circuit Court,
First Circuit, for trial at tho next
term. In the course of its decision
tho Court says: "But without doubt
if the repealing Act discloses the
manifest intention of tho Legisla
ture that, notwithstanding a general
saving statute, all prosecutions un
der the repealed Act should there
after bo at an end, tho particular in
tention must prevail." Tho Court,
however, finds nothing in Act 21, 1
G to show such intention. Attorney-General
Smith for prosecution;
