Tho Supremo Court by Justice
Frear has rendered a decision in the
ejectment cae of A. J. Lopez vs.
M. Kaiaikawaha and 1. Kaiaikawaha
her husband, and Ah Sam. It is an
action to recover a piece of land at
Waialua. At tho January term,
18!)J, before Chief Justice Judd, tho
jury gave a verdict for the defend
ants. The case was appealed upon
exceptions to tho refusal of tho pre
siding Justice to grant tho plain
tiff's motion for a now trial. It is
the unanimous opinion of the Su
preme Court that the exceptions bo
over-ruled. They make tho follow
ing lindings: 1, There is uot a mani
fest preponderance of ovideuce
against tho verdict. 2 Tho plain
till" has not shown sulhcient reason
for believing that tho defense of ad
verse possession would not bo sot
up. II, The plaintiff has not shown
that by reasonable diligence ho
could not have discovered the al
leged nowly discovered evidence be
fore tho trial. 1, Tho newly discov
ered evidence is merely cumulative
and not of a nature making it prob
able that a now trial would result in
a different verdict. , Title does
not pass by shoritrs deed on sale by
execution upon judgment in a Cir
cuit Court, unless a transcript of
said judgment has been docketed in
tho Supremo Court. 0, Such a deed
convoys only the interest which tho
judgment debtor has in the laud at
tho time of the sale. 7, A title after
ward acquired by the judgment
debtor does not inure to tho benefit
of the purchaser at tho execution

tho Supreme Court in damage suits
against the Wilder Steamship Com
pany for the losses of merchandise
in the burning of the Kahului ware
house. Chief Justice Judd being

Judge Cooper sat in tho case by re
quest. The decision is unanimous
and in favor of tho plaintiff, the fol
lowing being the syllabus:
"A receipt was given by the do
fondant steamship company for
goods forwarded by its steamer to
be delivered at l'aia, an inland place
ou Maui, tho exemptions in the re
ceipt being 'dangers of fire and navi
gation, or any other accident or
danger of the seas, rivers or steam
navigation, of whatsoever kind and
nature.' Tho goods wore landed
and destroyed by firo in tho ware
house bofore tho3' were lorwardeu to
Faia. Held, that the oxomptiou
from liability for loss by firo is lim
ited to loss 1)3 firo occurring at sea,
and does uot attach to tho laud
