o'clock. A witness was callod and
failing to appear tho Attornoj'-Gon-oral
stated that tho witness had boon
present a fow minutes boforo open
ing of the Court, and had stopped
out again.
Creighton wantod trial to go on.
Thos. "Wright, sworn, stated Am
acquainted with Walkor; am resi
dent 9.V years; acquainted with
Walkor all those years; had very
littlo conversation with Walkor; was
going homo on tho oars, tho Pro
visional Government was forming a
now company of rifles: I was going
to join the company; ho advised mo
not to join it, as I was an old friend
of his; ho advised mo as a friend, as
I-would him; ho said, thoy wore go
ing to wait pationtly until every
thing was settled by tho United
States; very littlo of importance was
said; sjJbko about same thing in
Nolto's; said somothirfg about blow
ing up, did not say what, one way or
the other.
Judge I will have to order tho
Courtroom cleared if tho noise con
tinues and command an officer to
enforce the clearance!
Creighton That order could not
bo enforcod, as wo aro entitled to a
public trial.
Witness, resuming Tho rifle
company was tho sharpshooters; he
said that something would bo blown
up if the decision wont against them;
may have told two or three others
during tho talk of revolutions;
Walkor said very littlo more, the
sum and substauco I have mention
ed; Walker was then under tho influ
ence of liquor, or else I might havo
noticed him more; ho said friends of
tho Government would be hurt if
tho decision went against them.
Cross-examined The substance of
Walker's statements to me was that
everything would bo peaceful until
tho United States' decision had boon
lucolvea.
Simon von Topns, sworn, stated
Am member of tbo guards; am ac
quainted with Walker, and had con
versation with him on more than one
occasion; mot Walker corner Hotel
and Fort within a few weeks; Walk
er asked me how I was getting
along, gotting S40 and good P. G.
grub, we had a drink together; ask
ed mo if I'd moot him again, and I
did; second mooting was two days
aftor tho first. ono on Bethel street;
ho asked mo if I'd havo a glass of
beer, and I said yes; wont to Anchor
Saloon; asked me about news; said
to mo that everything would be all
quiet soon; ho told me tho best
thing for us boys will bo to give up
quietly, and to got all tho names of
those who would like to como over;
ho said he would give the names to
the Queon; also said that there were
plenty of men in the Queen's place;
asked him how I would bo saved,
when ho told mo that when thoy
made attack to fall down and say,
"Tom Walker;" reported this to
Capt. Good; mot him again Wed
nesday last week and introduced
Prescott, membor of Co. A; Walker
asked mo how Prescott was, and I
told him he was all right; Blount
and Wodohouso had told them to bo
patiout; thoy had good financial
backing with Spreckols and Camp
boll; thoy hail lots of men; thoy
wore going to attack them soon;
Walker explained everything to
Prescott, aud ho asked for tho pass
word, and Walkor referred him to
mo, that I was a man ho depended
ou; Sinclair had come in tho first
time and Walkor ordered him out,
as ho said he had private business
with us; Walker said that they would
havo men outside to keep men from
going in; Walkor said that when the
Palace was built for Kalakaua a
secret passage way was built also
a pipe could be laid under tho Palace
to blow it up; Sinclair said that ho
was for annexation, but ho was not
for any missionary school; Walkor
said that ho had seventeen men
among the guards spying for them,

gave away any secrets Sinclair said
1 would bo shot; Prescott asked
again how ho could tell whon any of
the opposing loaders would come,
Walker and Sinclair said that on
Friday afternoon at '1:30 o'clock tho
pass would lio ready.

10 o'clock this morning.
