Anti-Scandal Law in Fiji.
That is n very questionable law
that lias been proposed iu Fiji, a
law" which js gonorally enforced
must, as tho Fiji papers say, hampor
lively conversation and make lifo
dull. It is to become actionable to
say of a person that she is not so
virtuous as she should bo. Those
are not the exact words, but they
are as near as wo care to go. Can
society bo so very much worse 'in
Fiji than olsowhoro that such a law
should bo necessary, or is a fasti
dious Government attempting tho
impossible? It is not altogether safo
to write freely about Sir John Thurs
ton. Whon handled too vigorously
ho suspects malice, sees unscrupuf
ousuess, and express himself at
length in dospatchos to tho homo
Government. So it is awkward to
have to choose between misjudging
the vjovoruor auu supposing that
Fiji society requiries bringing up
with a round turn. Thoy do talk, of
course, ovou whore there aro no
grounds. "Be thou chasto as ice,"
says the play 300 years old, "thou
shalt notescapocaluunry." Todecido
whether a law against scandal is
wanted iu Fiji one requires to know
whether tho talking is in excess of
the facts or corresponds with them;
but, whichever be thu case, tho
remedy lies rather in tho direction
of setting a good oxatnplo (such as
not wanting to hoar tho very latest
gossip) than iu croatiug now causes
of action. In tho first placo, juries
are human; in tho second place, tho
publicity of the courts is infinitely
worse than tho whisper of tho drawing-room;
and in tho third, tho
most injured people will never in
vokes tho law. Mischievous conver
sation is hardly to bo put down by
any other means than doing away
with the desire to hear entertaining
news at tho expouso of our friends
and acquaintances. Nothing is so
much onjoi'ed by tho public as read
ing about crimes or by privato cir
cles as hearing about, sin. Which
doos the avorago citizen profor as a
topic of conversation the claims of
tho Children's Hospital to tho
support of the charitable or
tho very latest theory about
thoso promissor3 notes? Tho
world, as wo have had occasion
to say boloro, would be very prosaic
but for the evil-doing that goes on
in it and gets written about in news
papers, novels, and historios. Tt is
whon someone goes sadly wrong that
wo find tho newspapers truly entor
tamiug; and who knows but whon
tho great account conies to bo mado
up, it may bo found that tho sinners
were sinning to save people of leisure
from ennui, damning themselves for
our good, and therefore entitled to
tho bonofit of an insolvency act. The
oldest and best recipe lor scandal
was not to go to tho lawyer or pub
lish contradictions, but to livo so
that tho world would not believe it.
And the world doos not really be
lieve a tenth part of what it hoars.
Society discusses tho frailties of tho
men and women it knows says that
their behavior is shocking, and yot
goes on asking them to dinner, or
dances with them at Govornmont
houso. The condemnation is largely
theoretical. Thoiois no offence to
take notico of till it aunoars in urint.
and Fiji socioty would bo likely to bo
more cruel to injured people who
complained in court of having boon
libelled than to know sinuers who
had tho.craft to avoid exposure. If
scandal-mongering is univorsal in
civilised Polynesia (tho uativo popu
lation does not call ovory-day topics
seaudal), tho juries will bo composod
of men as much to bo pitied as tho
plaintiff, and as given to evil-spoak-mg
as the defendant, llow it would
to have feminine juries juries of
exports? Scandal is largelj' a ques
tion of atmosphere. If tho writings
of Itudyard Kipling aro a truo de
scription of lifo in India, scandal is
tho ono compensation Europeans
got for dwolling iu a country with
such an awful climate. Wlioro the
tomporaturo is most languorous
scandal is tho most active. Only tho
busy and tho active escape, and you
can bo neither within tho Ironies.
Tho remedy, therefore, iu Fiji is
sumo means of artificially cooling
tho air, or nialto it a penal ofl'once to
bo idle, unless the object the Gov
ernment has in view is to find out
what people aro talking about, and
mako tho law reports lively reading.
