The defendant was brought before
the District Court of Vorth Hilo for
deserting contract work. He plead
etl that the contract under which
he served contained a punaltv

absent from work he should woik

of this penalty in the contract the
Court could not iinpo-m punishment
Upon this pica he was discharged,
and the matter was appealed to the
Supreme Court 011 the point of law
Involved. The decision of the I 'ourt
is that the penalty in the contract
could not be enforced by the law as
it stand, therefore the deserting la
borer was liable to the penalty of
the law for diverting contract "ser
