Judge Perry rendered his decison
on the case this morning as follows:
The statute of 1892 defines the duty
of this Court in cases of this nature
to be to consider whether there is
probable cause to believe that a jury
would upon the evidence adduced
convict the accused of the offense
with which they are charged, It is
not in its power to say whether or
not defendants aro guilty of such of
fense. The essence of tho offense
here charged consists in tho unlaw
ful agieement and combination of
the parties, and it is completed
whenover such combination is form
ed, although no act be done towards
carrying the main design into effect.
It is not evou necessary that the
means for tho accomplishment of
the desired object be sottlod or re
solved on at tho time. As soon as
tho union of two wills is perfected,
tho offense is complete; at any time
thereafter another may becomo a
partaker in it by joining the con
trivers, and tho least degree ol con
I sont or collusion is all that needs bo
J shown. The joint assent of the
minds may be established as an in
J ference from tho other facts proved,
I i. e., by circumstantial evidence.
First, as to defendant Weed. The
I evidenco adduced by the prosecu
I Hon, briefly stated, is that at tho
timo when the conspiracy is shown ,
to havo existed. Weed indulged in '

to witness Osmer in effect, "If you
havo any guns, bring thorn around." i

tained, that, for the purpose of
carrying out tho objects of tho
conspiracy, defendant Crick pro
cured arms aud ammunition, part
of which was stored by him on the
premises occupied by fiimsolf joint
ly with Van Gieseu, and nart de
livered to him in Hush's premises ,
aud later fouud there with other
arms by officers, in a secret recept
acle in a wall of Rush's place. For
the defense evidence was introduced
tending to show that in the middle ,
of January last, the attention of de
fendants was called to the fact that
McEvoy was a spy iu the employ of
the Govorumuut, and the same as to
Van Gieseu, some time later. Two
men engaged iu the printing room i
of defendant Rush iu the house I
where the alleged meetings, or cou-'
vocations took place, said that they '
did not think it possible that such
could have occurred without their
knowledge, but as to this, from the
further evidenco of those two men,

as also that of his wife and

meeting of Aug. 14 is said to have I

lama. But from all the evidence as
to the hour of the meeting, which
was not definitely fixed by McEvoy,
aud as to the hour when Nawahi sat
down to tho feast, which also was
not definitely fixed, it seems to me
that the two statements aro not
necessarily iucousistdut, and that
an alibi has uot beeu satisfactorily
proven. It is contended for the do
foudauts that the information con
veyed to them of Vau Gieseu's aud
MoEvoy's true office, renders it
highly improbable that confidences
were exchanged as alleged, but that
that information resulted iu belief
iu the minds of the defendants
seems to me to be disproved by their
later acts and conduct. The unlaw
ful combination aud agroemeut by
Hush, Crick aud Nawahi has iu my
opinion, been established by the
evidence 01 tho meetings and
strengthened bv that of the nurchase
t and possession of tho arms and
ammunition. Kealiziug the full
force of the reauiremeut of tho
Judiciary Act of 1KD2 as to a certifi
cate iu case of commitment, I find
that there is probable cause to be
lieve that a jury would, upon tho
evidenco adduccd.couvict defendants
Hush, Crick aud Nawahi of tho
offense with which they are changed,
and 1 commit them for trial to the
Circuit Court of the First Judicial
Circuit, Hawaiian Islands, at its next
