Short Time of Service
and Is Over-ruled.
Two Members of Commission Excused
on the Ground of Prejudice.
Ou the arraignment of V. V. Ash
ford, as reported in yesterday's pa
por, Air. Neumann filed an objection
that tho rule that charge aud speci
fications bo served on the prisoner
within five days of his arrest had not
been followed. Mr. Ashford had
not been served with such during
the time specified, aud the trial
could not bo proceeded with.
Col. Whitiug auuouncod that the
objection was ovor-ruled.
' Mr. Neumauu then asked if tho
Commission was governed by any
rules, aud if so ho would like to be
acquainted with them.

sion would follow the rules govern
ing military commissions elsewhoro.
Mr. Neumann asked if there were
any rules governing the time requir
ed for the serving of charge and
specifications on a prisoner. Mr.
Ashford had been in prison for
three weeks before such papers wore
served ou him.
The ruling was reaffirmed.
Mr. Neumann objected to the sit
ting of Captain J. W. Pratt ou this
Captain Fratt stated that ho hop
ed the Commission sustain the ob
jection. Tho Commission retired for deli
beration. Captain Pratt was ex
cused. Mr. Neumauu thou objected to
tho sitting of Captain Zieglor, ad
ding that tho relations between that
officer and the prisoner had beeu of
such a strained nature during tho
past two or three years that ho
thought Capt. Zieglor could not sit
ou the case with impartiality.
Captain Ziegler hoped the objec
tion would bo sustained.
The Commission retired. Captain
.icglor was excused.
Mr. Neumann reiterated his re
quest to be acquainted with tho
rules or manual uudor which the
Commission was governed, iu jus
tice to the prisoner.
Col. Whitiug stated that ho could
furnish tho information privately,
lie then proposed that tho Commis
sion adjourn until to-morrow, bo
cause the Commission, as now con
stituted, consisted of only live mem
bers. Tho Court adjourned till 10
Court convened at
Col. Whiting announced that
minutes would be read wheu
Court convened at 1 o'clock.

aud published his picture, and a
good-sized roll of these clippings
whichhe carries with him is sullicieut
to gain him an audieuce when he do
sires it from any particular person,
lie pays no fare, lie says, and la net
troubled with superfluous baggage.
His present destination is Houolulu,
he claims, where he goes to see what
maimer of being the deposed Queen
