against Voluoy V. Ashford wore
read by tho J udgo Advocato. The
charge was misprision of treasou by
having knowledge of a couspirauy
to overthrow tho llopublic of Ha
waii and concealing the same from
auy member of tho Executive Coun
cil, Court of Record, Marshal or De
puty Sheriu. The specifications
were in at voinoy v. asuioru uiu
commit misprision of treason by con
cealing information of tlurdispatch
iug a vessel to a foreign country for
the purpose of landing arms to be
usod in the overthrow of the llopub
lic of Hawaii.
Before allowing tho prisoner to
plead Mr. Nettuiauu would enter an
objection to the proceeding going

been served with the charge and
specifications within the lejjal time

the objection would not delay the

Third. The crime of which tho
prisoner is accused is Misprision ot
Treason, a statutory crime which,
by its dofitiitiou under the law, is
not an offeiibe agaiust the laws of
Fourth. That under tho Consti
tution and laws of the Republic ot
Hawaii the prisoner is entitled to a
trial by jury upou information, in
dictment and complaint, except in
cases of impeaohmeut.
Fifth. That under the rulos, re
gulations, usages aud laws of war
the prisoner is not onu of those per
sons over which a Court Martial,
Military Commission or other mili
tary tribuual convened by order of
the Commauder-iu-Chief has juris
diction. Sixth. That under the rules, re
gulations, usages aud laws of war
the offense with which the prisoner
is charged and for which ho is ar
raigned for trial Is not such offeuso
which a Court Martial or military
tribuual or auy tribuual convened
by order of the Commandor-iu-Chief
