Zncomo Tax Law Riddled.
The United States Supremo Court
has shot the inromo tax law full of
hides. Its decisiou was to be form
ally ratified at noon to-day. The
income tax lawns n whole is upheld,
but only by a divided court. All in
comes derived from rents are ex
empted from taxation by the Federal
Government, and all income deriv
ed from State and municipal bonds
are similarly exempted. In other
respects the income-tax law stands
as it was pased last August, but
the result of t ho contultmioiis in
the Supremo Court shows very con
cludvely thnt tho law can eauly be
I icked to piece piecemeal, provided
there is brought to contest each par
ticular point as it comes up.
It is a curious fact thnt the law
which was passed m the dictation of
the Populistiu wing of a Democratic
Congress has been distorted by the
decision of tho United States Su
preme Coutt, clearly ou constitu
ti'iual grounds, in such a way that it
will absolutely protect the cla-s of
capitalists most ollensivo to the

will pay no income tax. The owners
of bonds of almost any kind, either
Federal, Mate, county or municipal,
will also be free, while the bus uess
man, the manufacturer and the sala
ried employee will, for the present
at least, be compelled to contribute
to the Treasury of the United Sta'et
Government. 2 percent of all incomes
iu -xcess of $1000 per annum.
When the first vote was taken as
to the general principle of the con
stitutionality of a law of Cougress
taxing incomes it was found that the
court whs ovenly divided. Only
eight Justices heard the nrL'iimeuts.

Tho vote disclosed the fact that
Chief Justice Fuller and Justices
, Field, Gray aud Brewer were op
posed to the Jaw iu toto. They be
lieved it was unconstitutional ns
passed by Congress aud that it wns
a direct tax, which according to the
I Constitution, must bo levied among
, the States nccording to the popula
tion as roiurneu ity the census.
Justices Harlan, Brown, Shiras
and White voted to sustain the law
as a whole. Thov believed aud sup
ported their opinions by a convinc
ing argument that while portions of
tho law were clearlv unconstitu
tional, the general fleet of an in
come tax could not be considered ns
opposed to the principles laid down
in the constitution.
Tho most vigorous opponent of
the law throughout was Justice
Field, who would consent to no
compromise; who believed tho law
unconstitutional from begiuuiug to
end, and who supported his opinions
in nil the consultations in the most
vigorous and able manner. It is
entirely probable that ho will writw
and submit a strong dissenting
opinion, holding that tho law is tin
conMitutional in itself and hinting
nt the compromise which has been
readied by which certnin classes of
capitalists will be unduly favored
while others will hnvo to pay the
