It is in favor of tho dofondants. Tho plaintifl Lydia roquostod Desky to soil a lot of land for her, tho prico sho sot on it boing 5500, and agrood to pay him $300 commission if tho laud was sold. Dosky introduced a Mr. Homons to tho defendants, but ho thought tho price was too high and dooliued to purchaao. Homons aftorward spoko to his friend David Dayton about tho matter, and Dayton in duced tho dofondants to soil tho property to Homens for $5000. Tho defendants rofusod to pay tho commission to Dosky, nnd ho brought this suit to compel thorn to do so. It is hold by the Court that ho cannot claim tho commis sion, because ho was not tho di rect or oflloiont causo of soiling tho land at tho prico finallv agreed upon. Winslow, a rosident of Oakland, wus accidentally shot at a cabin eighteon miles from Bed ding, Cal., on July 27. Ho and his brothor-in-law, Hoiaco O. Lyle, bad been out hunting and returned iu tho evening to the cabin of E. P. Conner, Lyle's futhor-in-law. Lyle oloaned the guns and had just put a shell in tho second ono, when in somo way it was discharged. Winslow was sitting in tho doorway three feet ofi", and the ohargo ontorod his loft leg just below tho knee, going clear through the flesh and bono. It also glazed tho right leg and took tho skin nnd somo flesh oil'. Although Buffering mtonso pain, Winslow bound a handkerchief around his log above tho wound and held it whilo Lylo wont to tint Tower House for assistance. A doctor was soon brought and dresnod tho wound, and tho same evening Winslow was convoyed to Bedding, whoro tho wound wob again dressed. The sufleror was taken to his home at Oakland tho following day. At latost accounts it wob not certain that his leg could bo saved, as the wound is a serious ono Mrs. Winslow is a daughter of Mr. and Mrs James Lyla of this oity.
