Section 12. Tho Commissioners shull havo authority to
employ tho nocessary olorkB and surveyors for carrying on tho
work of tho Commission, and to fix thoir pay. Thoy shall also
fir tho pay of Sub-Agents and Rangers. Tho pay of tho Com
missionorn Bhnll bo fixed by tho Legislature
Section 13. The Agent of Public Lands shall bo tho aotive
business ropresontativo of tho Commissioners, and shall, under
thoir direction and through thoSub-Agontsorotherwiso, admin
lstor tho affairs of tho Public Lands under tho provisions of this
Aot, and shall havo authority to administor oaths in all matters
rotating to tho administration of tho Public Lands.
Section 14. Tho powers and duticB of Sub-Agents within
thoir rospoctivo Districts shall, subject to tho control of the
Commissioners and in addition to thoso otherwiso providod in
this Act, bo as follows:
1. To prevent unlawful occupation of or trespassing on

on such lands, to boromoved thorofrom and such animals to im
pound according to law.

cheat. 4. To enforco contracts respecting sales, leases, liconsos or
other disposition of Publio Lands.
5. To rooover ronlB, purchase monoys and other monoys
due tho Govornmont in respect of any sale, loasos, liconsos or
othor disposition of Publio Lands, or for uso and occupation
6. To rocovor money duo tho Government for injury or
damage dono to any Publio Lands by wrongful ontry and occu
pation or by wrongful removal thorofrom or destruction of any
property of the Government.
7. To bring such actions and proceedings as may bo noc
essary to carry out tho foregoing powers and dutios in the
namo of tho Governmont, and to dofond such actions brought
against tho Government as may bo authorized, in tho Courts of
tho'Distriot in relation to tho Publio Lands thoroof.
8. To keep a reoord of all his official transactions includ
ing all contracts mado by him with individuals and between in
dividuals in relation to Publio Lands within his jurisdiction,
and all surrenders, forfeitures and esohoats of such lands, and
facts of tho decoaso of any Occupier, Lessee or Freeholder and
names of the successors to their rights as such.
9. To administor oaths in all matters appertaining to the
administration of the Publio Lands.
Section 16. All disputes, disagreomonts or misunderstand
ings betwoon tho parties to any Certificate of Occupation, Home
stead Leaso, Right of Purohaso Leaso or Freohold Agrooment,
touching tho construction of suoh instruments or in anywise re
lating thereto, which cannot be amicably sottled, shall be refer
red to the Circuit Judgo in whose jurisdiction tho proraisos in
question are situated; and such Circuit Judgo shall havo full
and exolusivo authority in ohambors without tho intervention
of a Jury for adjudicating such matters, subjoot only to appoal
to tho Supremo Court.
Section 16. Land Patents shall bo signed by tho Presi
dont and countorsigned by tho Minister of tho Interior, and
shall bo stamped according to law, which Btamp shall bo paid
. by tho purchaser.
Section 17. Tho Commissioners may with the consent of
the Executive Council soil Public Lands not under leaso, in
parcels of not ovor ono thousand acros, at Publio auction for
cash. Upon nny suoh salo and tho paymont of tho full consi
deration thoroof, a Land Patont shall be issued to the pur
chaser. And they may, with such consont, soil Publio Lands not
under leaso in parcels of not over six hundred acres, at publio
auction upon part credit and part cobIi, and delivor possession
uudor an agrcemont of salo containing conditions of residenco
on or improvomont of tho premises sold, or of paymont by in
stallments or othorwiso of tho purchaHO price, or all or any of
