The Supromo Court has rend
ered a decision in tho assumpsit
suit of W. King vs. A. Hutchin
son on tho following contract:
"Studio, Nuuanu Avenue,
"Honolulu, March 21, '91.
"I agree to pay Mr. William

Judgo Whiting writes tho de
cision of tho Court, which is con
curred in by Chief Justico Judd
and Justico Frear. In tho Dis
trict Court of Honolulu judgment
was roudored in favor of tho
plaintiff. King, and defendant
appealed on tho following points
"1. Tho agreement iB illegal
boing mado by ono avIiobo' duty it
was to obtain tho host contract
without favoring any porson, tho
appoleo, W. King, boing n mom
bor of the Kalakaua Monumont
"Tho agreement has not boon
performed (a) by obtaining (if
that had been dono) a contract for
a Btatuo, and (b) because such
contract for a'statuo was not ob
tained." Tho law of the case is stated as
"H., a sculptor, agreed to pay
K. if K. obtained a commission
from an association for a 'statuo.'
No commission for a 'statuo' was
obtained; but after three years a
commission for a 'bust' was ob
tained from tho association. Hold,
that H. is not liablo to K. on the
agreomout to obtain a commission
for a 'statuo.' 'Statuo' ' construed
not to racau or iucludo a 'bust.' "
Accordingly tho court decides
as follows: "It is unnecessary to
consider tho iirst point raised.Tho
appeal is sustained, judgment ro
vorsed nnd the case remanded to
tho District Magistrato to enter
judgmont for dofondaut." P..

against the defendants upon a
promissory noto of tho lato Dr.
Trousseau, and produced ovidonco
that showod that tho claim was
presented on February 25, 1895,
and on February 20, 1895, was re
jected by tho dofondauts, and on
April 27, 1895, tho plaintiff began
her action and summons issued.
The Circuit Court dooided that
suit was not brought within tho
two months required by the law
rolating to claims in probate.
This decision is affirmed by tho
Supreme Court, which holds that
the statute of non-claim or Bpooial
limitations need not bo specially
pleaded liko the statute of limita
tions in personal actions. P.
