ed yesterday. Tho dofenso had

ly, as aftor two or three questions
ho was allowed to rotiro.
In arguing tho motion to dis
miss Marshal Brown contonded
that uudor tho evidence of the de
fendant's proceedings from tho
timo of leaving tho wharf until
ho was arrested ho had no possi
blo chanco of procuring tho opium
olsowhoro and thoreforo must havo
brought it off tho ship, and was in
consequonce guilty as charged.
On tho othor hand Paul Nou
mann ably contonded that thoro
was absolutely no ovidenco con
necting tho opium in court with
tho steamship Alameda, and con
sequently thoro could bo no con
viction. Judgo de la Vorgne said ho folt
constrained to grant tho motiou,
fully coinciding with tho views
held by Mr. Noumann as to tho
testimony. Tho main point to
him was tho fact adduced that tho
dofondant had passed closo to ono
customs ofticor and within, a fow
yards of anothor in leaving tho
wharf and that they both stated
thoy saw nothing Buspicious in
tho man's appearance. Ho hardly
thought a jury would convict tho
defendant under such ciicum
stances and should order him dis
charged. Tho defendant was at ouco re
arrested on the chargo of opium
in possession, to which ho plead
ed guilty and was sontouced to a
fine of S250 and thirty days in
jail. An appeal for mitigation of
ssntonce was at onco noted and
Urn Court fixed tho bond at S7C0.
This was furnished shortly after
ward, with Wm. G. Irwin as se
curity, and Sutton mado tho best
of his way to tho Alameda, which
was detuiued nearly an hour on
his account. Tho defendant
seemed to have tho sympathy of
tho passengers on the vessel, but
nono is expressed for him on
