An adverao decision to Dr. J.
II. lt'iymond, in his suit ngaiuet
tho Paia Plantation Co., haB been
rondered unanimously by tho
Supremo Court. Tho dootor claim
ed a feo for a "capital" operation
on a laborer of tho plantation in
Mnlulnni hospital at Wailnku.
As its defense tho plantation con
tended thnt n contract was nindo
by Mr. Everett, agent of tho Board
of Health, to treat tho plantation
employes for "overythiug" nt n
Hat rate. A jury found a verdict
in fftvor of Dr. Baymond.
Tho dotuudant appealed to tho
Suprduio Court for a now trial,
and that Court ordered a new
trial. Dr. Baymond then appeal
ed to tho Supremo Court for a ro
hearing, ono of his grounds being
"that the Couit overlooked the
questiouB whether Mr. Everett
was authorized to mnko the allcc-
ed contract nnd, if not, whether
tho Board of Uoalth rati lied the
contract if ono was made."
Another around was thnt the
Supremo Court considered cortnin
errors in tho change of tho trial
judge to tho jury, to which the
defendant did not except and
which wito not befoio this Court,
and tho Court granted a now trial
largely if not entirely upon said
The Court discusses these
prounds in its opinion written by
Justice Froar, and concludes in
...Hi r- i ..
xuo uourt in its opinion com
mooted upon several other mat
tors, not as grounds for ft no
trial, but to prevent aropetitiou of
errors on thonnwtrinl. Tho case,
wo mast confoss, was a difficult
oue to ilooido, but wo are of tho
opinion that sufficient grounds
for a rohonriug hnvo not been
shown and therefore tho motion is
A. G. M. Bobertsou for plain
tiff; Kinney &. Uallou for defen
dant. Tho position tho case is left in
is that iluro will bo n new trial of
it ut the November torm of tho
I irst C.rcuit Court.
