mitted. Thoro is direct criticism
of General Miles for failing
promptly to bring to tho nttontiou

beef, and "several individuals"
are consurod for failing to obeorve
Iho proprieties of their positions
as commanding oflicora in this
and other respects.
Tho Court takes tho position
that tho testimony is conclusive
that both tho refrigerated beof and
canned boot wero in good condi
tion when dolivored to tho Gov
ernment and continuod so until
issued to the troops, except in
epooial instances, when tho de
terioration was duo to accidental
conditions in the transportation or
to tho influences of tho tropioal
climato. Tho report admits tho
liability of rofrigeratod beef to
taint quickly of tor romoval from
tho ico-chosts. Tho court finds
tho chargos of "embalming" tho
fresh boef to havo boon unsub
stantiated by testimony and says
no chomicals were used to pre
serve it. The finding is also ad
verse to tho assertion on the part
of General Miles that tho use of
tho boef was an oxporimont.
Much attention is given to tho
charges concerning tho canned
roast boef, and it is stated that tho
testimony proves it to havo beon
wholesome and nutritious uhoro
used in moderation and under
favorablo circumstances. Tho po
sition is takon that too much of
this article of food was supplied
to tho men, and that under the
circumstances it was unpalatablo
and found undesirable as a con
tinuous ration. Tho fact is sot
forth that tho canned roast boef
had not beon used to any appreci
able oxtont beforo the beginniug
of this war, and it is thoreforo re
garded as practically an untried
In viow of this faot tho Com
miesary-Genoral of Subsistence is
roundly criticized for tho purchase
of the moat in such extensive
quantities. As to tho charactor
of tho moat foi wholpsomeness
and nutrition the reports of Pro
fessor Atwator and Ohittendon are
quoted at longth, sustaining tho
claims in his respect.
