Tbo effect of this olauso is to
subject tho public lands in Hawaii
to a special trust, limiting tbo rev
enue from or proceeds of the same
to tbo uses of the inhabitants of
the Hawaiian Islands for educa
tional or other public purposes.
This merely restricted the ubob to
wbiob the proceeds of suob lands
could bo put.bat did not in any wise
affect tbo previous provisions of
this clause, which conferrod upon
Congress tho sole aud absolute
authority to provide for tho man
agement and disposition of those
lands. Tho effect of tho languogo
quotpd is to vest in Congress the
Hxolusive right, by special enact
ment, to provido for tbo disposi
tion of public lands in Hawaii.
Possibly such would havo been
the offect of tbo resolution even if
tbis languago had not been insert
ed. Dut the languago having boon
expressly inserted, (hero can be
no doubt whatovtir but what tho
effect of tbo resolution is to do
privo tbo local Government of Ha
waii of all authority to dispose of
tbeso lands in any manner what
ever, oxcopt by virtue of epocial
laws enacted by Congress. The
fact that Congress has failed up to
this timo to logislato on tho sub
ject has not reinvested tho Hawai
ian Government with its former
power of disposition. That power
coaBcd upon tho cession. The
lands then became tbo property of
tho United States, and could be
disposed of ouly in accordance
with tho laws ot Congress. Uutil
Congress passes laws in conform
ity to the provisions of the resolu
tion providing ior (ho Bale or dis
position of tbeso lands, they must
remain undisposed of. That clause
of tbo resolution of annexation
wbiob directs that "until Congress
shall provido for the government
of Buoh Islands, all the civil, judi
cial, and military powers exorcised
by the oQicors of tho existing Gov
