C. M. Depow of Now York addressed
the United Stales Senate on tho Phil
ippine question. Following Is tho di

tho Bulletin's special service:
Mr. Depow declared that most of the
questions regarding tho Amcilnan oc
cupancy of tho Philippines which arc
now being discussed nro purely ncn

"Wo aic In the Philippines; wo arc
there to stny by conquest nud by treaty
rights. All which precedes tho ratifi
cation of tho tuaty by tho Senato of
the United States Is nn academic e ues
tlon." No one denied, he said, that the na
tives of tho Philippine Islands had been
used to help conquer tho Spanfh, but
ho denied that any ticaty had been
mado with them. Said ho:
"Only tho Piesldcnt of tho United
States could bind the country and he
only with the fc.ibscqucnt assent of tho
Senate. Only when war Is progressing
can tho commander-in-chief of tho
army or the nilmlr.il of tho navy make
n committal which tho President would
bo bound In nn form to consider or
respect. Admiral Vcwcy nlono had
that power, and ho most emphatically
denies any committal whatever to
Agulnaldo for tho independence of his
so-called government. President

committal on tho subject on tho part
of tho Philippine Commission. The

pines. Tho Act of October 31, 1S03, passed
by Congress and signed by Jefferson,
vested:
"All military, civil nnd Judicial
powers In such person or persons and
to be exercised in such manner as tho
President of the United States shall di
rect.' "There was no consultation with tho
Inhabitants, no participation In their
government accorded them, nnd no
rights assured to them except 'tho
frco enjoyment of their liberty, prop
erty and religion.' It is no answer
to this precedent to say that because
there wcro only 30,000 white- pcoplo In
tho territory it was unnecessary to
gain their consent. Tho constitutional
rights of 30,000 nro as precious and as
sacred as tho rlgljtB of 30,000.000.
"It has been repeatedly said hero
that government by tho United States
in these islands will be dcsnotlsm.
Such a belief shows a singular Ignor
ance or misapprehension of tho con
stitutional limitations upon our pow
ers and the spirit of our Institutions.
While, tho constitution does not ex
tend over tho territories of Its own
lorco nnd without legislation, Its pro
hibitions nro binding on Congress. In
thoso prohibitions, which nro also
privileges enjoyed by the pcoplo wher
ever our Jurisdiction extends is a
complete charter of rights which Con
gress can neither limit nor Impair. All
pcisonal privileges and Immunities,
such ns religious freedom, property
rights, freedom of speech and freedom
of the press and equality beforo tho
law must prevail wherever our flag
floats. Hut outsido of tho constitu
tion nnd laws Is an unwritten law
created by tho genius of the Institu
tions of tho paramount power and con
trolling Its nets and oillclals In all col
onial governments."
