caused by tlio action taken by tho

the suppression of the bubonic plague."
It Is, however, probable, Judging
from tho discussions which have taken
p.acc In the Council of State on tho
Court of Claims matter, the tho un
derstanding of tho Executive Council
ns to the meaning of tho words "JiiBt
claims," differs from that of the ma
jority of the Council of State.
Our view is that an authoritative
recognition of a claim as Just must be
In accordance with Hawaiian law. A
legislature has the authority to ex
tend the law. Neither tho Executive
Council nor the Counc.l of State bus
this discretion.
In regard to the necond paragraph ot
tho resolution, no reasons arc set forth
why the present Commissioners of the
Court of Claims should be dismissed,
and a new court bo appointed, of which
a majority "shall consist of Impartial
men acquainted with the values of
property and merchandise."
Tho Executive Council requlrcB that
nil the members of tne Court shall bo
Impartial. As to their being acquaint
ed with values of property, tnerc seems
to be no good reason for changing the
practice of precedents of nil Hawaiian
courtR, especially as nearly all the
propel .y in question has been delink
ed, and estimates of losses must be
made from testimony of witnesses and
not from the examination of goods
nnd buildings.
If the Court of Claims was merely a
board of appralseis to estimate tho
value of property by inspection. It
would be desirable ui. have experts on
the board, but as that Is not the easy,
the greatest possible usefulness of ex
perts is reached by using them as wit
nesses. Tho foregoing report was this day
adopted by the Executive Council.
