of larceny In tho second degree, was

E. M. Partrlget was arrested yestor
day on the cuuige of iiiuilciuim injury
by taking a rig from Jim Carty's sta
bles, Iu tho 1'ollco Court this fore
noon, defendant pleaded not guilty, af
ter n short trial, was discharged, lie
was Immediately arrested ngaln by or
der of Marshal Drown on the chargo of
Jim Carty stated that the defendant
had worked for him as night watch
man for a few nights and thnt he had
been discharged tho day beforo he took
the rig which, by the way, belonged to
Tho man who was on ns night watch
man tho night defendant took the rig.
stated that ho had no orders ngalnst
letting out rigs at night and allowed
defendant to tako a horso and buggy
which tho latter himself picked out.
The defendant himself went on the
stand In his own behalf. He was Sharp
ly questioned by Patrlgct and, during
tho courso of his testimony, it was
brought out that defendant was out for
a good time. He went to Dob Gardner's
place and remained there until ntter
C o'clock yesterday morning.
Marshal Drown accused tho man of
drunkenness nnd mado tho charge that
ho had taken the rig, knowing It to
bo tho property of private parties, sim
ply to spite Mr. Carty.
Upon the defendant being discharg
ed, Marshal Drown ordered tho man
out of tho room and then sent Hanra
han to arrest him on tho chargo qt
drunkenness and tako him below to bo
