At 3 p. in. yesterday tho prosecution
rested In tho trial of William Eston,
tho negro charged with murder for the
killing of Toyo Jnckson. Judge Stan
ley granted n recess of ten minutes for
consultation wlta defendant by his
counsel. Tho Jury was warned ngalnst
reading nccounta of the trial In the af
ternoon papers. Clerk J. A. Thompson
saved them troublo by scissoring tho
Bulletin's report out of the copies for
Mr. Crelghlon made nn able address
to tho Jury on behalf of tho defendant.
Ho claimed thcro was not n particle of
evidence connecting tho knife exhibit
ed with tho defendant. Tho verdict
should bo either guilty or not guilty of
murder, and If defendant stabbed Jnck

Mr. Dolo was eloquent nnd dramatic
In his address for tho Republic. With
tho knife In his hand ho showed how
It might have been concealed by tho
defendant, when ho camo back to the
saloon ana lurked In tho doorway bo
foro advancing toward Jackson and
Cockctt. As to tho theory of tho do
fenae, regarding a possibility that
Jackson might have held tho knlfo
and had It turned upon himself In tho
scuffle, Mr. Dolo hold such nn utter Im
possibility. Thcro was no tlmo unac
counted for, wherein Jackson could
have opened a knife. Eston could not
havo dono so himself In the Ave sec
onds or so of tho tussle In tho alley
way, therefore ho must havo opened
tho weapon when ho left tho Pacific
saloon tho first time, and returned
holding It in readiness to revenge tho
blow given him by Jackson before.
After receiving tho charge of tho
Court, tho Jury retired at G:20 and In
twenty minutes returned with a unani
mous verdict of "guilty of manslaugh
ter in tho first degree." Tho penalty for
this homicidal offense Is Imprisonment
for not less than ten, nor moro than
twenty years. Sentence will bo pro
nounced tomorrow morning. Defen
dant's counsel have given notice of mo
tion for a new trial.
