missioner of the General Land OfTlce,
In the city of Washington, D. C, an
application and motion for hearing as
to questions of law and fact touching
upon your legal authority as Commli
sloner of Public Ijinds for tho Terri
tory of Hawaii, as provided by the Or
ganic Act, approved April 30, 1900, and
questioning your authority to offer for
sale, or make other final disposition,
under any agreement or conditions
whatever, of any portion of the public
domain of the United States, in tho
Territory of Hawaii. And that on
Bald 20th day of September, A. D. 1300,
or as soon thereafter as counsel may
be heard, the protcstants herein nam
ed, by their attorneys, will submit to
the Honorable Commissioner of tho
General Land Orflce, at Washington, D.
C, such evidence and arguments ai
may be admissible on all matters hero
in referred to. That, at such time and
place of hearing as may be designated
by the Commissioner of tho Gencr.il
Land Office, the following specified er
rors on your part, as Commissioner of
Public Lands for the Territory of Ha
waii, will be presented and to him
submitted."
Here follow' ten counts of error In

errors as follows: In unauthorized pub
lication of sale (Insomuch as such pub
lication was without proclamation by
tho President of tho United States as
lequlred by law; In actual exposure
for salo without act of Congress there
for; In fixing prices per aero. In same
cases more, In others less, than tho
prlco fixed by law; In offering such
lands for salo on less than thr0
months' notice; in restricting the pur
chaser to only fifty acres. Instead of the
ono hundred and sixty acres as allow
ed by law; In offering to sell the public
lands of Hawaii at all, for the reason
that they havo been transferred to the
United States, and their title Is in the
United States, and that they arc there
fore In contemplation of liuv tinsurvey'
ed lands and cannot bo disposed 'if
that any attempt to dispose of sail
lands Is In violation of the Executlvo
Order of President McKlnley, of the
11th day of September, 1899, which 13
now In full force and effect; that con
ditions of payment and residence, con
corning tho disposition of said lands,
made by tho Commissioner, aro with
out authority of United States law:,
that the said Commlbsioncr of Public
Lands, J, F. Brown, erred In advertis
ing these lands for salo, on tho ground
that no Territory of the United States
possesses tho sovereign power to rt
celve as grantee, and to grant and
transfer as grantor, any portion of tho
public domain of the United Stalut,
within the boundary of such Terrltoiy,
until such Territory Is fully admitted
Into the United States as a State; and
that the Commissioner erred In exceed
ing his authority, for tho reason that it
is against public policy and not con
ducive to the public welfare to proceed
with such agreements and dispositions
without tho authority of tho United
States and complete Instruction.

own nnd can't use as a reservation to
ensure them waterheads and water
