Dear Sir The undersigned desires t'i

ditches or tunnelling, as circumstances
may require, for bringing water from
the reservoirs so located onto the lands
below and occupied by our company.
In consideration of a conclusion of
this character wo would undertake:
First To fence tho lands ns near cat
tle and hog proof as conditions will
Second To make, a thorough and
systematic cleaning1 out of wild hoj
and cattlo now roaming on the larids
and destroying trees of small growth,
Third To place In charge n compe
tent forester and three, assistants en
tirely at our own expense whoso duty
shall be to clear tho lands of lantann
and other noxious underbrush nnd to
replant such portions as have been de
nuded by Are or other causes, and to
prevent such wanton destruction of tho
forests In tho future.
All work covered by agreements
herein to bo performed to tho satlsfac
slon of tho commlmssloncr of agricul
ture or his authorized agent, and tho
replanting of lands to bo accomplished

gallons of water a day for household
and domestic use.
G. Thnt the party of the second part
shall convey nil Its rights In the water
of both branches at and above the
dams to bo constructed, but not any
below tho branch be mado appurtenant
to the lands of tho Wahiawa Settle
ment Association pro rata to tho area
of tho respective holdings, for use only
on such lands provided one owner may
divide hla sliaro with another..
S. Thnt all the water and water pow
er from the reservoir at tho foot of
tho colony lands shall be furnished to
stockholders In proportion to their
shares at rates to be established; pro
vided thnt tho party of the second part
have tho right, at such rates, to use all
tho surplus water power not used upon
tho lnnds of tho Wnhlana Settlement
9. That charges for water for Irriga
tion shall bo one-third of one cent per
miner's Inch per hour, and no more
whero supplied by gravity, and for do
mestic use not less than two cents nor
more than five cents for each 1000 gal
lons. A miner's Inch Is nine gallons
That water which has to bo supplied
by tho party of the second part (Wnla
lim Agricultural Co.) to kuleana hold
ers or others having vested rights Is
to bo supplied by the now corporation
without chnrge, und If charged to tho
party of tho second part when taken
from reservoirs credited back to the
party of the second part. "And said
party of the second part agrees to ac
quire any and all of said vested rights
when practicable and to terminate said
freo supply without expense to any
other of tho parties hereto."
11. That tho party of the second ptrt
agrees to take nnd pay for all water
not required by the othet parties.
12. Thnt all wood now growing on
lnnds ngrccd to bo conveyed to tho cor
poration is reserved to the owners cf
such lands respectively.
